TITLE OF BILL: An act to amend the environmental conservation law, in relation to big game hunting in the counties of Broome, Chenango and Tioga

PURPOSE: The purpose of this legislation is to allow sportsmen to hunt deer and bear in Broome, Chenango and Tioga counties with rifles and other arms.

SUMMARY OF PROVISIONS: Item (I) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 11 of chapter 183 of the laws of 2010.

JUSTIFICATION: In several areas of the State, sportsmen are allowed to hunt bear and deer with rifles and this change in law would allow the use of rifles in Broome, Chenango and Tioga counties.

LIBOUS -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to big game hunting in the counties of Broome, Chenango and Tioga THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by chapter 600 of the laws of 1993, is amended to read as follows: Regular open hunting seasons for [deer] BIG GAME are established sepa- rately for the named regions or parts of regions, or named counties listed in column one of the table set forth in this subdivision, and are specified as seasons for taking by pistol, rifle, shotgun, or long bow, or for taking by shotgun or long bow only, or for taking by long bow only, as indicated in column three entitled "Manner of Taking". Where taking of big game by shotgun is permitted by this chapter such shotgun may contain rifling in all or a portion of the barrel, provided, howev- er, if the barrel or a portion thereof does contain rifling only shells having non-metallic cases, except for the base, may be used. In the areas identified in column one except in the "closed areas" specified in subdivision 5 the game specified in column two may be taken in the open season stated in column two immediately following the specification of the game, in the manner specified in column three. S 2. Items (f) and (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, item (f) as amended by chapter 323 of the laws of 2011 and item (i) as amended by chapter 231 of the laws of 2012, are amended and a new item (k) is added to read as follows: (f) Southern tier, Deer, first Monday Pistol, shotgun,
central and Western after November 15 crossbow, region, except those through first Tuesday muzzle loading firearm counties or portions after December 7 or long bow only thereof listed in item (i) [or], (j) OR (K) of this paragraph (i) The counties of Deer, the first Monday Pistol, shotgun, Allegany, Cattaraugus, after November 15 muzzle loading Cayuga, Chautauqua through first Tuesday firearm, rifle or except that portion after December 7 long bow only of the county north of route 20, Chemung, [Chenango,] Herkimer, Madison, Montgomery, Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, [Tioga,] Wyoming and Yates [and that portion of the county of Broome east of the Susquehanna river] (K) THE COUNTIES DEER AND BEAR, PISTOL, SHOTGUN, OF BROOME, CHENANGO THE FIRST MONDAY CROSSBOW, MUZZLE AND TIOGA AFTER NOVEMBER 15 LOADING FIREARM, THROUGH THE FIRST RIFLE OR LONG TUESDAY AFTER BOW ONLY DECEMBER 7 S 3. Items (f) and (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, item (f) as separately amended by chapter 108 of the laws of 1995 and section 1 of chapter 600 of the laws of 2005 and item (i) as separately amended by chapter 441 of the laws of 2009 and chapter 231 of the laws of 2012, are amended to read as follows: (f) Southern tier, Deer, first Pistol, shotgun, central and Western Monday after November muzzle loading firearm region, except those 15 through first or long bow only counties or portions Tuesday after thereof listed in December 7 item (i) OR (K) of this paragraph (i) The counties of Deer, the Pistol, shotgun, Allegany, Cattaraugus, first Monday after muzzle loading Cayuga, Chemung, November 15 through firearm, rifle or [Chenango,] Herkimer, first Tuesday after long bow only Madison, Montgomery, December 7 Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben[, Tioga] and Yates
[and that portion of the county of Broome east of the Susquehanna river] S 4. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 2 of chapter 600 of the laws of 2005, is amended to read as follows: (i) The counties of Deer and bear, the Pistol, shotgun, Allegany, BROOME, first Monday after muzzle loading Cattaraugus, November 15 through firearm, rifle or Chenango, Herkimer, first Tuesday after long bow only Montgomery, Oneida, December 7 Oswego, Otsego, Schoharie and Tioga [and that portion of the county of Broome east of the Susquehanna river] S 5. This act shall take effect immediately, provided that the amend- ments to the opening paragraph of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such paragraph pursuant to chapter 600 of the laws of 1993 and shall be deemed to expire therewith; the amendments to item (f) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section two of this act shall be subject to the expiration and reversion of such item pursuant to chapter 323 of the laws of 2011, as amended, and to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section two of this act shall be subject to the expiration and reversion of such item pursuant to chapters 321 and 326 of the laws of 2011, when upon such date the provisions of section three of this act shall take effect; provided further, that the amendments to items (f) and (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section three of this act and item (k) of such paragraph as added by section two of this act, shall be subject to the expiration and reversion of such paragraph pursuant to section 13 of chapter 600 of the laws of 1993, as amended, when upon such date the provisions of section four of this act shall take effect.
