Any merchant, manufacturer, firm, corporation, association or agent or employee thereof who offers for sale in this state any component part of a pistol or firearm to any individual who does not possess a valid pistol permit shall be guilty of a class D felony. The component part being purchased must be a component part to the pistol or firearm listed on the purchaser1s valid pistol permit. 2. For purposes of this section "firearm" or "pistol It means a weapon as defined in section 265.00 of this article.

JUSTIFICATION: The availability of illegal firearms remains a serious threat to public safety, and is a constant problem facing law enforcement officers in New York State. Requiring a purchaser to produce a valid firearm license for a specific weapon or its components would severely restrict the ability to create or repair firearms for illegal use.
