BILL NUMBER:S3623 TITLE OF BILL: An act to amend the public health law, in relation to contents to be contained in a certificate of death PURPOSE: Provides that where death is caused by injuries relating to terrorist attacks on 9/11/2001 the certificate of death shall indicate such information. SUMMARY OF PROVISIONS: Section 1. Subdivision 4 of section 4141 of the public health law, is amended by adding a new paragraph (e) and Section 2. Subdivision 3 of section 4143 of the public health law as amended by chapter 545 of the laws of 1965, is amended. JUSTIFICATION: Presently anyone who did not perish within the first few days of the 911 terrorist attacks will have their documents of death classified as "Natural". It is imperative to all victims of this tragedy especially those first responders who participated in the search and rescue efforts that the cause of their death be noted properly for recognition sake as well as any benefits that may come available for their families. AN ACT to amend the public health law, in relation to contents to be contained in a certificate of death
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 4 of section 4141 of the public health law is amended by adding a new paragraph (e) to read as follows:
(E) WHERE A DEATH IS CAUSED BY INJURIES RELATED TO THE TERRORIST ATTACKS ON SEPTEMBER ELEVENTH, TWO THOUSAND ONE, SUCH INFORMATION SHALL BE INDICATED, INCLUDING ANY RELATED INFORMATION AS THE COMMISSIONER MAY REQUIRE.
S 2. Subdivision 3 of section 4143 of the public health law, as amended by chapter 545 of the laws of 1965, is amended to read as follows:
3. The coroner or medical examiner whose duty it is to investigate the death and to execute the certificate of death, shall state in such certificate the name of the disease causing death, or if from external causes, the means of death; whether probably accidental, suicidal or homicidal; OR WHERE A DEATH IS CAUSED BY INJURIES RELATING TO THE TERRORIST ATTACKS ON SEPTEMBER ELEVENTH, TWO THOUSAND ONE, SUCH INFORMA TION SHALL BE INDICATED, and shall, in any case, furnish such informa tion as may be required by the commissioner in order to classify the death.
