BILL NUMBER:S3635 TITLE OF BILL: An act relating to creating a green energy emergency backup program PURPOSE: To provide a grant program to assist owners of retail motor fuel stations with the installation of emergency back-up generators powered by renewable energy sources. SUMMARY OF PROVISIONS: Section 1-creates the program and directs NYSERDA to promulgate rules and regulations to administer it. Further, it makes clear that potential recipients shall be subject to a competitive process for awards, and makes clear that the money to fund the program which is capped at $25 million, will come from Federal funds made available to the state to address the impact of Hurricane Sandy Section 2-Sets forth the effective date JUSTIFICATION: One of the many problems that New Yorkers faced in the aftermath of Hurricane Sandy was a severe shortage of available gasoline in the downstate region. This was as a result of a lack of back-up generators at retail fuel stations, which made it impossible to utilize pumps. In the aftermath of the storm, and as recovery continues, it is important to address the short term problems faced by residents affected by the storm, like the inability to access adequate supplied of gasoline and also the longer term problems related to the potential impacts that changes in the climate are having in terms of increasing the frequency of severe weather patterns. This bill addresses both sets of concerns, by providing assistance to the owners of retail motor fuel stations who are looking to install back-up generation, while at the same time encouraging these small business owners to use renewable technologies and advanced battery storage devices that are better for our environ- ment. AN ACT relating to creating a green energy emergency backup program
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. 1. Notwithstanding any other provision of law, rule or regulation to the contrary, a Green Energy Emergency Backup Program shall be created and administered by the New York state energy research and development authority. 2. The New York state energy research and development authority will promulgate rules and guidelines for a program aimed at providing assist ance to owners of retail motor fuel stations that seek to install renew able energy backup systems powered by renewable energy sources, includ ing but not limited to solar and wind power. Funds provided through this program shall also allow for assistance in installing battery backup technology or other energy storage devices. 3. The authority shall conduct competitive solicitations for proposals and establish clear criteria for awards. Such competitive solicitations shall be designed in a manner and form to be determined by the authority as well as a schedule for such competitive solicitations, award selection and distribution of funds. The authority shall rank proposals received in response to competitive solicitations and choose the highest ranked proposals measured on the criteria established. No single recipi ent shall receive a grant exceeding fifty percent of the total installed cost of the project. 4. The authority shall make available $25 million from federal funds allocated to the state of New York for hurricane relief which were appropriated in January of 2013, that are not already directly earmarked for another clearly delineated statutory purpose, for the establishment of this grant program.
