BILL NUMBER:S3639 TITLE OF BILL: An act to amend the general municipal law, in relation to dedicating veterans' memorials as parklands in the state of New York PURPOSE: To provide statutory protection for veterans' memorials on public property throughout New York State. SUMMARY OF PROVISIONS: Section 1 amends the general municipal law by adding a new subsection to provide that any public property donated to or designated by a state or local governing body for the purpose of creating or maintaining a memorial to the veterans of any armed conflict engaged in by the armed forces of the United States be considered parkland, and subject to all legal provisions afforded to designated parkland in New York State. Section 2 states that this law shall take effect immediately. JUSTIFICATION: This legislation designates veterans memorials on publicly owned property as parkland and affords such property the protection of existing state procedures related to the alienation of parkland when such changes are considered. Currently, there are not adequate protections in law to protect veterans' memorials. This legislation will protect veterans' memorials to insure that the valuable purpose veterans memorials serve in our society will not be diminished. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the general municipal law, in relation to dedicating veterans' memorials as parklands in the state of New York
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The general municipal law is amended by adding a new section 72-s to read as follows:
S 72-S. ALIENATING PUBLIC PROPERTY USED AS A VETERANS' MEMORIAL. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW, PUBLIC PROPERTY WHICH HAS BEEN DONATED TO OR HAS BEEN DESIGNATED BY ANY STATE OR LOCAL GOVERN ING BODY, AND USED FOR THE PURPOSE OF CONSTRUCTING OR LOCATING A MEMORI AL TO THE VETERANS OF ANY WAR OR CONFLICT ENGAGED IN BY THE ARMED FORCES OF THE UNITED STATES, SHALL BE DEDICATED AS PARKLAND IN THE MUNICIPALITY WHEREIN SUCH PROPERTY EXISTS. SUCH DESIGNATED PUBLIC PROPERTY SHALL NOT BE ALIENATED, DEVELOPED, LEASED, TRANSFERRED, SOLD OR DISCONTINUED FOR USE AS A MEMORIAL SITE UNLESS SUCH ACTION IS APPROVED BY
AN ACT OF THE STATE LEGISLATURE.
