BILL NUMBER: S368 TITLE OF BILL : An act authorizing the commissioner of environmental conservation to undertake projects to protect national historic landmarks from shore erosion PURPOSE : This legislation would authorize the Commissioner of Environmental Conservation to undertake projects that protect national historic landmarks from shore erosion. SUMMARY OF PROVISIONS : This is a special act to authorize the Commissioner of Environmental Conservation to undertake projects that protect national historic landmarks from shore erosion, notwithstanding any other laws to the contrary. JUSTIFICATION : The New York State Department of Environmental Conservation is a partner with other levels of government to protect national historic landmarks from shore erosion. However, current law does not allow a State agency to enter into agreements with not-for-profit organizations which significantly limits the ability of some sites to take necessary action to protect against shore erosion. For example, the Montauk Lighthouse, located on the East End of Long Island, has been designated by the United States Secretary of the Interior as a national historic landmark. The site was deeded to the Montauk Historical Society by an act of Congress in 1996. As the owners, the Montauk Historical Society is precluded from entering into

Notwithstanding any provision of law to the contrary, the commissioner of environmental conservation shall also be authorized to undertake any project to protect a national historic landmark, as desig- nated by the United States Secretary of the Interior, from shore erosion.
