BILL NUMBER:S3681 TITLE OF BILL: An act to amend the insurance law, in relation to certificates of insurance; and to amend chapter 552 of the laws of 2014 amending the insurance law relating to certificates of insurance, in relation to the effectiveness thereof PURPOSE: To make technical amendments to Chapter 552 of 2014. SUMMARY OF PROVISIONS: Section 1 amends Article 5 of the Insurance Law, enacted by Chapter 552 of the laws of 2014. These changes would clarify that: prohibitions against falsely amending certificates shall be applicable to addenda to such certificates; personal liability insurance and property liability insurance certificate forms must be approved by the Department of Financial Services; and the penalty for violating the article shall be $1,000 for a first offense and $2,000 for a subsequent offense, following a notice and hearing. Section 2 of the bill provides for a 180 day effective date, and provides that Chapter 552 of 2014 shall become effective on the same date.

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the insurance law, in relation to certificates of insur- ance; and to amend chapter 552 of the laws of 2014 amending the insur- ance law relating to certificates of insurance, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 5 of the insurance law, as added by chapter 552 of the laws of 2014, is amended to read as follows: ARTICLE 5 CERTIFICATES OF INSURANCE Section 501. Definitions. 502. Prohibitions. 503. [Applicability. 504.] Enforcement. [505.] 504. Rules and regulations. S 501. Definitions. For purposes of this [section] ARTICLE: (a) "Certificate" or "certificate of insurance" means any document or instrument, OR ADDENDUM THERETO no matter how titled or described, [which is] prepared or issued by an insurer or insurance producer as evidence of [property or casualty] PROPERTY/CASUALTY insurance coverage. "Certificate" or "certificate of insurance" shall not include a policy of insurance or AN insurance binder[, and does not amend, extend or alter the coverage provided by the policy of insurance to which the certificate makes reference, and is subject to all the terms, exclusions and conditions of such policy. A certificate of insurance shall not confer to any person new or additional rights beyond what the referenced policy of insurance expressly provides]. (b) "Certificate holder" means any person, other than a policyholder, that is identified on the certificate as a certificate holder.
