BILL NUMBER:S3749 TITLE OF BILL: An act to amend the retirement and social security law, in relation to eliminating the earnings limitation for retired police officers employed as school resource officers PURPOSE: Removes the earnings limitation for retired police officers while employed as school resource officers SUMMARY OF PROVISIONS: Section 1: Section 212 of the retirement and social security law is amended by adding a new subdivision 3. JUSTIFICATION: Retired police officers are well-qualified to protect our students as school resource officers. Currently, retired public employees must apply for a "211 Waiver" in order to earn more than $30,000 per year. This process, can often become burdensome. The cap on earnings can deter those best qualified to protect our children from becoming school resource officers. This bill would allow school districts to hire retired police officers without needing a "211 Waiver." LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: This bill would remove earnings limitations for certain employees of a school district, however this is not a mandate for districts to increase salaries. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the retirement and social security law, in relation to
eliminating the earnings limitation for retired police officers
employed as school resource officers
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 212 of the retirement and social security law is
amended by adding a new subdivision 3 to read as follows:
3. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION,
SUCH EARNINGS LIMITATIONS SHALL NOT APPLY TO A RETIRED POLICE OFFICER
EMPLOYED BY A SCHOOL DISTRICT AS A SCHOOL RESOURCE OFFICER.
S 2. This act shall take effect immediately.
