BILL NUMBER:S3752 TITLE OF BILL: An act authorizing the town of Webster to transfer and convey the Robb Cemetery to the village of Webster PURPOSE OR GENERAL IDEA OF BILL: This bill would authorize the town of Webster to transfer and convey the Robb Cemetery to the village of Webster. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Notwithstanding any provision of town law to the contrary, the town of Webster, acting through its legislative body, is hereby authorized to discontinue. the use of the abandoned pioneer cemetery known as Robb cemetery, described in section two of this act, and convey its interest in such real proper- ty to the village of Webster, county of Monroe, following a public hear- ing, upon terms agreed upon by the town of Webster and the village of Webster to restore and maintain such cemetery, Such transfer shall be made only upon the adoption of a.resolution by the board of trustees of the village of Webster requesting the town of Webster to make such transfer. Section 2: the real property authorized to be conveyed by the town of Webster pursuant to section one of this act shall be described as follows: the parcel of land constituting the abandoned pioneer cemetery known as Robb cemetery, with tax account number 080.10-2-34, situated adjacent to and immediately west of 256 East Main Street in the Town of Webster Section 3: The land to be transferred pursuant to this act shall be maintained, owned and operated by the village of Webster. JUSTIFICATION: The Town of Webster shall have the authority to transfer title and responsibility for the care and maintenance of an abandoned cemetery located within the village of Webster and known as Robb Ceme- tery. AN ACT authorizing the town of Webster to transfer and convey the Robb Cemetery to the village of Webster
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any provision of town law to the contrary, the town of Webster, acting through its legislative body, is hereby authorized to discontinue the use of the abandoned pioneer cemetery known as the Robb cemetery, described in section two of this act, and convey its interest in such real property to the village of Webster, county of Monroe, following a public hearing, upon terms agreed upon by the town of Webster and the village of Webster to restore and maintain such cemetery. Such transfer shall be made only upon the adoption of a resolution by the board of trustees of the village of Webster requesting the town of Webster to make such transfer.
S 2. The real property authorized to be conveyed by the town of Webster pursuant to section one of this act shall be described as follows: the parcel of land constituting the abandoned pioneer cemetery known as the Robb cemetery, with tax account number 080.10-2-34, situ ated adjacent to and immediately west of 256 East Main Street in the town of Webster.
S 3. The land to be transferred pursuant to this act shall be main tained, owned and operated by the village of Webster.
