S3778-2011 Memo
BILL NUMBER:S3778 TITLE OF BILL: An act to amend the public authorities law, in relation to tickets purchased for use on the Long Island Rail Road PURPOSE OR GENERAL IDEA OF BILL: To eliminate the cost of mandated surcharges for the cancellation of Long Island Rail Road tickets within six months of their original purchase. SUMMARY OF SPECIFIC PROVISIONS: Section 1205 of the public authorities law is amended by adding subdivision 9; requiring the Metropolitan Transit Authority to reimburse one hundred percent (100%) of the purchase price for unused Long Island Rail Road tickets returned within six months of the date of purchase and prohibiting the assessment of any surcharge or processing fee for the returned ticket. JUSTIFICATION: On December 30, 2010, the Metropolitan Transit Authority (MTA) Board adopted a new refund policy for tickets purchased for the Long Island Rail Road (LIRR). The recently instituted policy invalidates Unused One Way and Round Trip tickets within two weeks of the purchase date. For a full refund, any unused tickets must be returned within 30 days of the purchase date. Prior to this policy's enactment, LIRR tickets had been valid for up to sixth months. In addition to the reduction in the amount of time allowed for full-refund ticket returns, the new policy also includes a $10 refund processing fee for each ticket return transaction. In most cases, the $10 processing fee is more than the cost of the purchased One-Way ticket. This policy discourages transit riders from obtaining a refund, losing the cost of the ticket if they are unable use the ticket within 14 days. This legislation will eliminate the inequitable charge of the $10 processing fee for refunded tickets and prolong the use of tickets for a reasonable amount of time. PRIOR LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATIONS: Unknown. EFFECTIVE DATE: This act shall take effect on the thirtieth day after it shall have become a law.
