BILL NUMBER:S3778C TITLE OF BILL: An act to amend the public authorities law, in relation to one-way or round trip tickets purchased for use on the Long Island Rail Road PURPOSE OR GENERAL IDEA OF BILL: To eliminate the cost of mandated surcharges for the cancellation of one-way or round trip Long Island Rail Road tickets within one year of their original purchase. SUMMARY OF SPECIFIC PROVISIONS: Creates Section 1266-j of the public authorities law; requiring the Metropolitan Transit Authority to extend the validity of one-way or round trip Long Island Railroad tickets to one year from the date of purchase and to reimburse one hundred percent (100%) of the purchase price for unused one-way or round Long Island Rail Road tickets returned within six months of the date of purchase and prohibiting the assessment of any surcharge or processing fee for the returned ticket or otherwise increasing the cost of tickets for refunding their full value. JUSTIFICATION: On December 30, 2010, the Metropolitan Transit Authority (MTA) Board adopted a new refund policy for tickets purchased for the Long Island Rail Road (LIRR). The recently instituted policy invalidates Unused One Way and Round Trip tickets within two weeks of the purchase date. For a full refund, any unused tickets must be returned within 30 days of the purchase date. In addition to the reduction in the amount of time allowed for full refund ticket returns, the new policy also includes a $10 refund processing fee for each ticket return transaction. In most cases, the $10 processing fee is more than the cost of the purchased One-Way ticket. This policy discourages transit riders from obtaining a refund, losing the cost of the ticket if they are unable use the ticket within 14 days. This legislation will eliminate the inequitable charge of the $10 processing fee for refunded tickets and prolong the use of tickets for a reasonable amount of time. PRIOR LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATIONS: Unknown. EFFECTIVE DATE: This act shall take effect on the thirtieth day after it shall have become a law.

AN ACT to amend the public authorities law, in relation to one-way or
round trip tickets purchased for use on the Long Island Rail Road
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The public authorities law is amended by adding a new
section 1266-j to read as follows:
S 1266-J. LONG ISLAND RAIL ROAD; REIMBURSEMENT. NOTWITHSTANDING ANY
OTHER PROVISION OF LAW, ANY ONE-WAY OR ROUND TRIP TICKET PURCHASED FOR
USE ON THE LONG ISLAND RAIL ROAD SHALL BE VALID FOR ONE YEAR FROM THE
DATE OF PURCHASE AND THE AUTHORITY SHALL REIMBURSE ONE HUNDRED PERCENT
OF THE PURCHASE PRICE OF ANY UNUSED LONG ISLAND RAIL ROAD ONE-WAY OR
ROUND TRIP TICKET TO THE BEARER OF SUCH TICKET, PROVIDED THAT SUCH TICK-
ET IS RETURNED WITHIN SIX MONTHS OF THE DATE OF PURCHASE. THE AUTHORITY
IS PROHIBITED FROM ASSESSING ANY SURCHARGE OR PROCESSING FEE OR OTHER-
WISE ROUNDING UP THE ACTUAL COST OF A HIGHER CLASS TICKET UPON THE
RETURN OF ANY SUCH UNUSED ONE-WAY OR ROUND TRIP TICKET PURCHASED FOR USE
ON THE LONG ISLAND RAIL ROAD.
S 2. This act shall take effect on the thirtieth day after it shall
have become a law.
