                                 BILL NUMBER:  S381

 TITLE OF BILL :  An act to amend the public health law and the
education law, in relation to establishing the high need primary care
medical personnel demonstration program; and providing for the repeal
of such provisions upon expiration thereof

 PURPOSE :

Establishes the high need primary care medical personnel demonstration
program in the department of health.

 SUMMARY OF PROVISIONS :

Section 1: Article 2 of the public health law is amended by adding a
new title 7 to read as follows: "High Need Primary Care Medical
Personnel Demonstration Program."

Section 2 shall give authority to the department of health to
establish a high need primary care medical demonstration program.

Section 3 amends subdivision 1 and 2 of section 6526 of the education
law by specifying the eligibility requirements.

Section 4 enacting clause.

 JUSTIFICATION :

Health disparities are caused by many factors, one of which is access
to quality, consistent care. Many underserved communities, whether
urban or rural, face daunting health disparities, partly because of a
lack of quality and consistent care.  This bill seeks to ameliorate
that situation by allowing the Department of Health to create a
demonstration program for residency in certain underserved communities
across New York State. The Department shall select six (6) locations
which shall participate in the demonstration program. The Commissioner
shall select the six (6) locations based on the following criteria:
(i) the amount of primary care medical services provided by the
applicant; (ii) the percentage of patients receiving care through
Medicaid; (iii) the capacity of the applicant to host medical
personnel licensed pursuant to section 6525 of the Education law, and
(iv) the benefit to a high-needs community in additional primary care
medical personnel. This demonstration program is open to any person
who graduates from a New York State, Liaison Committee on Medical
Education, or American Osteopathic Association accredited medical
program, or a person who graduates from any other medical program who
has passed  requisite steps or parts of the United States Medical
Licensing Examination or National Board of Osteopathic Medical
Examiners examination, where such a person practices at a medical
facility or practice approved by the Department of Health.

 EFFECTIVE DATE :
This act shall take effect on the ninetieth day after it shall have

AN ACT to amend the public health law and the education law, in relation

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Short title. This act shall be known and may  be  cited  as
the  "high  need  primary  care  medical personnel demonstration program
act".
  S 2. Article 2 of the public health law is amended  by  adding  a  new
title 7 to read as follows:
                                TITLE VII
                      HIGH NEED PRIMARY CARE MEDICAL
                          PERSONNEL DEMONSTRATION
                                  PROGRAM
SECTION 267. HIGH  NEED  PRIMARY  CARE  MEDICAL  PERSONNEL DEMONSTRATION
               PROGRAM.
  S 267. HIGH NEED PRIMARY CARE MEDICAL PERSONNEL DEMONSTRATION PROGRAM.
1. THE DEPARTMENT SHALL ESTABLISH  A  HIGH  NEED  PRIMARY  CARE  MEDICAL
PERSONNEL  DEMONSTRATION  PROGRAM.  THE COMMISSIONER SHALL DESIGNATE SIX
LOCATIONS AT WHICH SUCH PROGRAM SHALL BE CONDUCTED.
  (A) THE LOCATIONS OF THE DEMONSTRATION PROGRAM SHALL BE SELECTED BASED
UPON THE FOLLOWING:
  (1) THE AMOUNT OF  PRIMARY  CARE  MEDICAL  SERVICES  PROVIDED  AT  THE
LOCATION APPLYING FOR DESIGNATION;
  (2)  THE PERCENTAGE OF PATIENTS RECEIVING CARE THROUGH MEDICAL ASSIST-
ANCE;

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

  (3) THE CAPACITY OF THE APPLICANT LOCATION TO HOST PHYSICIANS LICENSED
PURSUANT TO SECTION SIXTY-FIVE HUNDRED TWENTY-FIVE OF THE EDUCATION LAW;
AND
  (4)  THE  BENEFIT  TO  THE  APPROPRIATE  HIGH  NEED  COMMUNITY  IN THE
PROVISION OF PRIMARY CARE MEDICAL PERSONNEL.
  (B) THE LOCATIONS OF THE DEMONSTRATION PROGRAM SHALL BE AS FOLLOWS:
  (1) TWO SHALL BE IN RURAL AREAS, AS  DEFINED  IN  SUBDIVISION  ONE  OF
SECTION TWENTY-NINE HUNDRED FIFTY-ONE OF THIS CHAPTER;
  (2)  TWO  SHALL  BE IN CITIES HAVING A POPULATION OF ONE HUNDRED FIFTY
THOUSAND OR MORE; AND
  (3) TWO SHALL BE IN CITIES HAVING A POPULATION OF ONE MILLION OR MORE.
  2. ON OR BEFORE APRIL FIRST, TWO THOUSAND SEVENTEEN, THE  COMMISSIONER
SHALL  SUBMIT  A  REPORT TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE
SENATE, THE SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER OF  THE  SENATE
AND  THE MINORITY LEADER OF THE ASSEMBLY. SUCH REPORT SHALL INCLUDE, BUT
NOT BE LIMITED TO, A STATISTICAL  ANALYSIS  OF  THE  CHANGES  IN  HEALTH
RESULTS  FOR PATIENTS AT DEMONSTRATION PROGRAM LOCATIONS, AND THE HOSPI-
TALIZATION RATES, CHRONIC ILLNESSES AND VITAL STATISTICS THEREOF.
  3.  ALL  DEMONSTRATION  PROGRAM  LOCATIONS  SHALL  UTILIZE  PHYSICIANS
LICENSED  PURSUANT  TO  SECTION  SIXTY-FIVE  HUNDRED  TWENTY-FIVE OF THE
EDUCATION LAW.
  S 3. Subdivisions 1 and 2 of section 6525 of  the  education  law,  as
added  by  chapter 987 of the laws of 1971, paragraph 1 of subdivision 1
as amended by chapter 133 of the laws of 1982, are amended  to  read  as
follows:
  1.  Eligibility: The following persons shall be eligible for a limited
permit:
  (1) A person who fulfills all requirements for a license as  a  physi-
cian  except those relating to the examination and citizenship or perma-
nent residence in the United States;
  (2) A foreign physician who holds  a  standard  certificate  from  the
educational  council  for foreign medical graduates or who has passed an
examination satisfactory to the state board for medicine and in  accord-
ance with the commissioner's regulations; [or]
  (3)  A foreign physician or a foreign intern who is in this country on
a non-immigration visa for the continuation of medical  study,  pursuant
to  the  exchange  student  program  of  the United States department of
state[.]; OR
  (4) A PERSON WHO  GRADUATES  FROM  A  REGENTS,  LIAISON  COMMITTEE  ON
MEDICAL EDUCATION OR AMERICAN OSTEOPATHIC ASSOCIATION ACCREDITED MEDICAL
PROGRAM,  OR  A  PERSON WHO GRADUATES FROM ANY OTHER MEDICAL PROGRAM WHO
HAS PASSED ELEVEN REQUISITE STEPS OR PARTS OF THE UNITED STATES  MEDICAL
LICENSING EXAMINATION OR NATIONAL BOARD OF OSTEOPATHIC MEDICAL EXAMINERS
EXAMINATION,  WHERE  SUCH  A  PERSON  PRACTICES AT A MEDICAL FACILITY OR
PRACTICE DESIGNATED BY THE DEPARTMENT OF HEALTH PURSUANT TO SECTION  TWO
HUNDRED SIXTY-SEVEN OF THE PUBLIC HEALTH LAW.
  2.  Limit  of  practice.  A  permittee shall be authorized to practice
medicine only under the supervision of a licensed physician and only  in
a  public,  voluntary[,] or proprietary hospital, OR PURSUANT TO SECTION
TWO HUNDRED SIXTY-SEVEN OF THE PUBLIC HEALTH LAW.
  S 4. This act shall take effect on the ninetieth day  after  it  shall
have become a law, and shall expire and be deemed repealed July 1, 2017.

SHALL  SUBMIT  A  REPORT TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE
SENATE, THE SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER OF  THE  SENATE
