TITLE OF BILL:
An act
to amend the public authorities law, in relation to requiring
the development of a
generation attribute
tracking system by the New York state energy
research and development authority

PURPOSE:
The purpose of this bill is to prepare a tracking system for
generation attribute certificates. As New York State moves closer to
a market system in which energy is bought and sold through a
certificate mechanism, it is important to track the creation of the
energy generated. as well as when this energy is bought and sold in
the marketplace to ensure the credibility of the generation attribute
certificate market.

SUMMARY OF PROVISIONS:
This bill amends section 1851 of the public authorities law by adding
a new subdivision 18, and amends section 1854 of the public
authorities law by adding a new subdivision 19.

JUSTIFICATION:
This legislation requires the New York State Energy Research and
Development Agency NYSERDA) to establish a tracking system for
generation attribute certificates, which are defined as "the
environmental, vintage and other attributes associated with the
generation of kilowatt hours and/or megawatt-hours of electrical
energy". NYSERDA will be required to consult with the Department of
Public Service in the development of this tracking system. As New
York, and the country. moves toward a market based system to
stimulate renewable energy generation, New York State must begin to
develop the infrastructure necessary to successfully monitor the sale
and trade of this commodity.

  AN ACT to amend the public authorities law, in relation to requiring the
    development of a generation attribute tracking system by the New  York
    state energy research and development authority

    THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section 1. Section 1851 of the public authorities law  is  amended  by
  adding a new subdivision 18 to read as follows:

    18.  "GENERATION ATTRIBUTE CERTIFICATES" SHALL MEAN THE ENVIRONMENTAL,
  VINTAGE AND OTHER ATTRIBUTES ASSOCIATED WITH  THE  GENERATION  OF  KILO-
  WATT-HOURS AND/OR MEGAWATT-HOURS OF ELECTRICAL ENERGY. GENERATION ATTRI-
  BUTE  CERTIFICATES  SHALL  EXIST  AS A COMMODITY SEPARATE AND APART FROM
  KILOWATT-HOURS AND/OR MEGAWATT-HOURS.
    S 2. Section 1854 of the public authorities law is amended by adding a
  new subdivision 19 to read as follows:

    19. TO, ON ITS OWN OR THROUGH A QUALIFIED ENTITY,  DIRECTLY  OR  INDI-
  RECTLY, AND IN CONSULTATION WITH THE DEPARTMENT OF PUBLIC SERVICE:

    (A) DEVELOP AND ADMINISTER A GENERATION ATTRIBUTE TRACKING SYSTEM THAT
  RECORDS GENERATION ATTRIBUTE INFORMATION WITHIN THE STATE, AND PROCESSES
  GENERATION  ATTRIBUTE  INFORMATION FROM ENERGY OUTSIDE THE STATE THAT IS
  IMPORTED TO AND CONSUMED WITHIN THE  STATE,  AS  A  BASIS  FOR  CREATING
  GENERATION ATTRIBUTE CERTIFICATES;

   EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                        [ ] is old law to be omitted.

    (B) ASSIGN INITIAL OWNERSHIP OF GENERATION ATTRIBUTE CERTIFICATES;
    (C)  PROVIDE  FOR THE TRANSFER OR CONVEYANCE, OWNERSHIP AND RETIREMENT
  OF GENERATION ATTRIBUTE CERTIFICATES;
    (D) OBTAIN GENERATION, DELIVERY AND CONSUMPTION INFORMATION FROM INDE-
  PENDENT SYSTEM OPERATORS,  GENERATORS,  PUBLIC  UTILITY  COMPANIES,  AND
  RETAIL  LOAD-SERVING ENTITIES PRODUCING, DELIVERING OR SELLING ELECTRIC-
  ITY IN THE STATE, INCLUDING, BUT NOT LIMITED TO, "ELECTRIC CORPORATIONS"
  AS DEFINED UNDER SUBDIVISION THIRTEEN  OF  SECTION  TWO  OF  THE  PUBLIC
  SERVICE  LAW, "COOPERATIVES" AS DEFINED UNDER SUBDIVISION (A) OF SECTION
  TWO OF THE RURAL ELECTRIC COOPERATIVE LAW, AND ANY PUBLICLY- OR  MUNICI-
  PALLY-OWNED UTILITIES, INCLUDING THE POWER AUTHORITY OF THE STATE OF NEW
  YORK  AND  THE  LONG  ISLAND  POWER  AUTHORITY,  DEEMED NECESSARY BY THE
  AUTHORITY TO VERIFY OR SUPPLEMENT  SUCH  GENERATION  ATTRIBUTE  TRACKING
  SYSTEM;
    (E) FACILITATE PARTICIPATION IN, AND USE OF, SUCH GENERATION ATTRIBUTE
  TRACKING  SYSTEM  BY  BUYERS,  SELLERS  AND  BROKERS WITH RESPECT TO THE
  OWNERSHIP, TRANSFER OR CONVEYANCE, AND RETIREMENT OF  GENERATION  ATTRI-
  BUTE CERTIFICATES; AND
    (F)  PERFORM  SUCH ADDITIONAL ACTIVITIES AS MAY BE DEEMED NECESSARY BY
  THE AUTHORITY TO ENSURE COOPERATION AND THE SMOOTH EXCHANGE OF  INFORMA-
  TION  AMONG  AND  BETWEEN  THE  GENERATION ATTRIBUTE TRACKING SYSTEM AND
  SIMILAR SYSTEMS WITHIN OR OUTSIDE THE STATE.
    S 3. This act shall take effect immediately.
