TITLE OF BILL: An act to amend the workers' compensation law, in relation to coverage of community emergency response teams

PURPOSE OR GENERAL IDEA OF BILL: Allows the town of New Castle, county of Westchester to include CERT teams as employees for purposes of coverage

SUMMARY OF SPECIFIC PROVISIONS: Section 1 of this bill would amend the workers' compensation law to allow the Town of New Castle, county of Westchester to include its community emergency response team (CERT) as employees in its arrangements and contracts with the state insurance fund.

Section 2 of the bill states the effective date.

JUSTIFICATION: This legislation was requested by the town of New Castle.

The town's Community Emergency Response Team (CERT) provides a critical homeland security and disaster preparedness capabilities to the town of New Castle.

These dedicated volunteers are on hand to plan and respond for local emergencies in a similar manner to volunteer firefighters and volunteer ambulance workers, whom the Town is currently allowed to insure under the State Insurance Fund.

This legislation would allow the town to add the volunteers of CERT team to their insurance rider in the same manner.

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to coverage of community emergency response teams THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The workers' compensation law is amended by adding a new section 88-d to read as follows: S 88-D. COVERAGE OF COMMUNITY EMERGENCY RESPONSE TEAMS. 1. THE FOLLOW- ING MUNICIPALITIES THAT EMPLOY COMMUNITY EMERGENCY RESPONSE TEAMS (CERT) MAY INCLUDE SUCH TEAMS AS EMPLOYEES IN THEIR ARRANGEMENTS AND CONTRACTS WITH THE FUND: TOWN OF NEW CASTLE, COUNTY OF WESTCHESTER. 2. COMPENSATIONS PAYABLE UNDER THIS CHAPTER TO COMMUNITY EMERGENCY RESPONSE TEAMS (CERT) SHALL BE PAID FROM THE STATE INSURANCE FUND, AND ALL PAYMENTS TO THE STATE INSURANCE FUND FOR INSURANCE PREMIUMS ON ACCOUNT OF SUCH EMPLOYEES INCLUDING A PROPORTIONATE SHARE OF THE ADMIN- ISTRATIVE EXPENSE OF THE STATE INSURANCE FUND ON ACCOUNT THEREOF SHALL BE PAID OUT OF THE GENERAL FUND OF THE STATE TREASURY FROM MONEYS DEPOS- ITED TO THE CREDIT OF THE PUBLIC SERVICES FUND THEREIN. S 2. This act shall take effect immediately.
