BILL NUMBER:S3911 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to the release of animals from a pound or shelter PURPOSE: To allow the release of animals to other entities in addition to adoptees or owners to increase chances for adoption. This bill is a technical correction to Chapter 419 of the Laws of 2010, in which "shelter" was inadvertently excluded from the chapter language. SUMMARY OF PROVISIONS: This bill amends subdivision 7-a of section 117 of the agriculture and markets law, as amended by Chapter 419 of the Laws of 2010, to provide that a pound, shelter, society for the prevention of cruelty of animals, humane society, dog protective association, dog control officer, peace officer or any agent thereof may release a dog or cat to another pound, shelter, society for the prevention of cruelty of animals, duly incorporated humane society or duly incorporated animal protective association if such action is reasonably likely to create an opportunity for the adoption of such dog or cat within a reasonable period of time. EXISTING LAW: Chapter 419 of the Laws of 2010 amended the law to enable pounds to transfer animals to any of the above-named entities/persons, to enhance an animal's chance for adoption. Unfortunately, the words "animal shelters" were inadvertently excluded from this amendment. JUSTIFICATION: This legislation will ensure that whenever there are areas of the state which experience increased demand for dogs or cats and the supply of such animals is readily abundant in other areas of the state, other animal shelter-type entities may transport such animals to another shelter and release the animals to that shelter for the purpose of facilitating adoption. Animal shelters were inadvertently excluded from the 2010 amendments, this bill amends that law to rightfully grant shelters the same authority as pounds and other entities named in the bill. AN ACT to amend the agriculture and markets law, in relation to the release of animals from a pound or shelter
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 7-a of section 117 of the agriculture and markets law, as amended by chapter 419 of the laws of 2010 and such section as renumbered by section 12 of part T of chapter 59 of the laws of 2010, is amended to read as follows:
7-a. Any animal in the custody of a pound OR SHELTER shall be made available for adoption or euthanized subject to subdivisions six, eight and nine of this section and subject to the provisions of section three hundred seventy-four of this chapter after the time for redemption has expired; provided, however, that such release may be made to another such pound, duly incorporated society for the prevention of cruelty to animals, duly incorporated humane society or duly incorporated animal protective association for the sole purpose of placing such animal in an adoptive home, when such action is reasonably believed to improve the opportunity for adoption.
