TITLE OF BILL: An act to authorize Domingo Cabrera to file a retroactive application for retirement with the New York state teachers' retirement system

PURPOSE:

This bill would allow Domingo Cabrera to receive retirement benefits from the New York State Teachers' Retirement System.

SUMMARY OF SPECIFIC PROVISIONS:

Section I. Domingo Cabrera suffers from mental illness and ended employment on January 1, 2009. This bill deems Domingo applied to the New York State Teachers' Retirement System for disability retirement benefits within 30 days of ending employment on January 1, 2009. This would negate the day he officially applied to the New York State Teachers' Retirement System for retirement benefits, May 19, 2011.

Section II. The costs incurred in implementing this act will be borne by the New York State Teachers' Retirement System.

JUSTIFICATION:

Domingo Cabrera is unable to work due to his mental illness. Due to his mental illness, Domingo Cabrera did not file for retirement benefits within 30 days of ending his employment on January 1, 2009. Domingo Cabrera is unable to be a self-sustaining member of society without receiving retroactive benefits offered by the New York State Teachers' Retirement System's retirement benefits. It is necessary for Domingo Cabrera to receive retroactive retirement benefits because these monetary benefits will allow Cabrera to be a sustaining member of society.

STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to authorize Domingo Cabrera to file a retroactive application for retirement with the New York state teachers' retirement system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, Domingo Cabrera, a member of the New York state teachers' retirement system, who ceased his employment as a teacher with the Mamaroneck union free school district on January 2, 2009, because of mental illness, and for reasons not ascribable to his own negligence did not file an appli- cation to such system for disability retirement benefits until May 19, 2011, shall be deemed to have applied to the New York state teachers' retirement system for disability retirement benefits within 30 days of his ceasing to be employed on January 2, 2009. S 2. All costs incurred in implementing the provisions of this act, shall be borne by the New York state teachers' retirement system. S 3. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill concerns Domingo Cabrera, a vested member of the New York State Teachers' Retirement System who ceased his employment as a teacher with the Mamaroneck Union Free School District on January 2, 2009 because of mental illness, and did not apply for disability retirement benefits until May 19, 2011, after the 12 month deadline to apply for disability had lapsed. He shall be deemed to have to applied for disa- bility retirement benefits within 30 of ceasing his employment on Janu- ary 2, 2009. As a vested member Mr. Cabrera is eligible for a service retirement benefit commencing at age 55.
