TITLE OF BILL:  An act to amend the New York state urban development
corporation act, in relation to establishing a community development
financial institution disability housing program

PURPOSE OF BILL:  Requires the office of temporary and disability
assistance to conduct a homelessness study.

SUMMARY OF PROVISIONS:

Section 1 of the bill directs the Office of Temporary and Disability
Assistance will conduct a homelessness study. The study will include,
but not be limited to:

* The current shelter allowance and eviction prevention supplements, in
light of increasing costs for housing;

* If the fuel and utilities is contributing to evictions, overcrowding
and homelessness;

* If fuel and utilities is constraining the ability of the private
sector to provide safe and affordable housing to low-income New Yorkers;

* If the requirement that a family is sued for eviction before they can
access a rent supplement program is reasonable considering that it

imposes litigation costs on landlords who are providing affordable hous-
ing, increases state and local costs for court administration leaves
tenants with negative credit that may inhibit their ability to find
employment and secure housing in the near and future, and limits the
program to others in need including those who are forced to move because
of domestic violence.

* If the fuel and utilities is constraining the ability of public hous-
ing authorities to maintain the condition and safety of their buildings;

* If the shelter allowance should be correlated to the HUD Fair Market
Rent levels which are updated annually and based on real housing cost
data;

Section 2 requires that by June 30, 2016, the office will provide a
report to the governor, the speaker of the assembly, temporary president
of the senate, the minority leaders of the senate and assembly and the
chairs of the social services committees in the senate and assembly.

Section 3 is the effective date

JUSTIFICATION:  This legislation is critical to know the true picture of
homelessness across New York State for the Legislature and the Governor
to make decisions based on the most accurate information possible to
make sure that children's and families have a place to call home.
Furthermore, the increasing number of low-income New Yorkers facing the

possible loss of their housing and the challenges of moving families
from homeless shelters into stable housing are greater than ever, this
legislation will give us a true picture of that and give us the tools
necessary to act.

AN ACT to amend the New York state urban development corporation act, in
  relation to establishing a community development financial institution
  disability housing program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1 of chapter 174 of the laws of 1968,  constituting
the  New  York  state  urban  development corporation act, is amended by
adding a new section 16-x to read as follows:
  S 16-X. COMMUNITY DEVELOPMENT FINANCIAL INSTITUTION DISABILITY HOUSING
PROGRAM. 1. LEGISLATIVE INTENT. THE LEGISLATURE HEREBY  FINDS  THAT  THE
INCREASED  DEVELOPMENT  OF  HOUSING SUITABLE FOR INDIVIDUALS WITH MENTAL
AND DEVELOPMENTAL DISABILITIES IS A  PRIORITY  OF  THE  STATE  AND  THAT
COMMUNITY  DEVELOPMENT  FINANCIAL  INSTITUTIONS CAN EFFECTIVELY LEVERAGE
PUBLIC FUNDS TO FINANCE THE CONSTRUCTION OF THIS KIND OF HOUSING.
  2. DEFINITIONS. AS USED IN THIS SECTION,  THE  FOLLOWING  TERMS  SHALL
HAVE THE MEANINGS INDICATED:
  (A) "COMMUNITY DEVELOPMENT FINANCIAL INSTITUTION" OR "CDFI" SHALL HAVE
THE  SAME  MEANING AS SUCH TERMS ARE DEFINED IN SUBDIVISION 2 OF SECTION
16-O OF THIS ACT.
  (B) "COMMUNITY DEVELOPMENT FINANCIAL INSTITUTIONS FUND" SHALL MEAN THE
FUND AS DEFINED IN SUBDIVISION 2 OF SECTION 16-O OF THIS ACT.
  (C) "SUPPORTIVE LIVING FACILITY" SHALL HAVE THE SAME MEANING  AS  SUCH
TERM  IS  DEFINED  IN  SUBDIVISION  28-B  OF  SECTION 1.03 OF THE MENTAL
HYGIENE LAW.
  (D) "SUPERVISED LIVING FACILITY" SHALL HAVE THE SAME MEANING  AS  SUCH
TERM  IS  DEFINED  IN  SUBDIVISION  28-A  OF  SECTION 1.03 OF THE MENTAL
HYGIENE LAW.

  3. PURPOSE. THE CORPORATION SHALL  ALLOCATE  FUNDS  IN  THE  COMMUNITY
DEVELOPMENT  FINANCIAL  INSTITUTIONS  FUND  NOT  TO  EXCEED  TWENTY-FIVE
MILLION DOLLARS TO COMMUNITY DEVELOPMENT FINANCIAL INSTITUTIONS INVOLVED
IN THE FINANCING AND DEVELOPMENT OF  SUPPORTIVE  AND  SUPERVISED  LIVING
FACILITIES  IN  ORDER TO DEVELOP ADDITIONAL HOUSING FOR INDIVIDUALS WITH
DEVELOPMENTAL AND MENTAL DISABILITIES IN THE STATE.
  4. RULES AND REGULATIONS. THE CORPORATION, IN  CONSULTATION  WITH  THE
OFFICE  OF MENTAL HEALTH, THE OFFICE FOR PEOPLE WITH DEVELOPMENTAL DISA-
BILITIES AND THE OFFICE OF ALCOHOLISM AND SUBSTANCE ABUSE SERVICES SHALL
BE AUTHORIZED TO PROMULGATE RULES AND REGULATIONS IN ACCORDANCE WITH THE
STATE ADMINISTRATIVE PROCEDURE ACT THAT ARE  NECESSARY  TO  FULFILL  THE
PURPOSES OF THIS SECTION.
  5.  ALLOCATIONS  OF FUNDS PURSUANT TO THIS SECTION SHALL BE SUBJECT TO
ALL THE PROVISIONS OF SECTION 16-O OF THIS ACT.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law; provided, however, that effective immediate-
ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
necessary  for  the implementation of this act on its effective date are
authorized and directed to be made  and  completed  on  or  before  such
effective date.
