BILL NUMBER:S4049 TITLE OF BILL: An act to amend the tax law, in relation to extending the authorization granted to the county of Essex to impose an additional three-quarters of one percent of sales and compensating use taxes PURPOSE: To extend the authorization of the county of Essex to impose an additional three quarters of one percent tax to the existing three percent sales and compensating and use taxes through November 30, 2013. SUMMARY OF PROVISIONS: Section 1: amends chapter 274 of the laws of 2009 to extend the authority of Essex County to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate which is three-quarters of one percent additional to the three percent rate authorized until November 30, 2013. Section 2: Contains effective date. EXISTING LAW: Clause 36 of subparagraph (i) of the opening paragraph of section 1210 of the tax law, as amended by chapter 274 of the laws of 2009 expires on November 30, 2011. JUSTIFICATION: The Essex County Board of Supervisors has requested the introduction of legislation to extend their authority to impose an additional three quarters of one percent sales and compensating use tax to November 30, 2013. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None to the state. LOCAL FISCAL IMPLICATIONS: It is estimated that the additional three-quarters of one percent will generate $4,560,000 on an annual basis. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the tax law, in relation to extending the authorization granted to the county of Essex to impose an additional three-quarters of one percent of sales and compensating use taxes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Clause 36 of subparagraph (i) of the opening paragraph of section 1210 of the tax law, as amended by chapter 274 of the laws of 2009, is amended to read as follows:
(36) the county of Essex is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate which is three-quarters of one percent additional to the three percent rate authorized above in this paragraph for such county for the period beginning June first, two thousand four, and ending November thirtieth, two thousand [eleven] THIRTEEN;
