TITLE OF BILL:

An act
to amend subdivision 19 of section 246 of chapter 81 of the laws of 1995
amending the vehicle and traffic law and other laws relating to the
enforcement of support through the suspension of driving privileges, in
relation to the effectiveness thereof

PURPOSE OF BILL:

This bill would extend the driver's license suspension process, one
of the most effective enforcement tools for child support collections
in New York State.

SUMMARY OF PROVISIONS:

Section one of the bill would amend subdivision 19 of section 246 of
Chapter 81 of the Laws of 1995 to extend the driver's license
suspension process from June 30, 2011 to June 30, 2013.

Section two of the bill would provide for an immediate effective date.

EXISTING LAW:

Subdivision 19 of section 246 of Chapter 81 of the Laws of 1995
contains the sunset provision for the child support driver's license
suspension laws. The provision currently expires on June 30, 2011.

PRIOR LEGISLATIVE HISTORY:

This provision was last extended by Part R of Chapter 57 of the Laws
of 2009 from June 30, 2009 to June 30, 2011.

STATEMENT IN SUPPORT:

This bill extends a highly successful enforcement tool, the driver's
license suspension process. Under the driver's license suspension
process, an administrative mechanism is used to: (1) identify parents
who fail to pay child support and who have driver's licenses; and (2)
notify such persons that their driver's licenses will be suspended
unless they make their child support payments. The loss of this
successful enforcement tool would have a considerable impact on child
support collections and on families in New York State.

BUDGET IMPLICATIONS:

Extending the sunset provision authorizing the Support Collection Unit
to administer the driver's license suspension process will prevent
the annual loss of child support collections. The driver's license
suspension process accounts for child support collections of up to as
much as $10 million annually. The failure to continue the driver's
license suspension process additionally would result in the loss of a
powerful deterrent for the non-payment of child support obligations.


EFFECTIVE DATE:

This act shall take effect immediately and shall be deemed to have
been in full force and effect on and after June 30, 2011.

AN ACT to amend subdivision 19 of section 246 of chapter 81 of the  laws
  of  1995  amending the vehicle and traffic law and other laws relating
  to the enforcement of support through the suspension of driving privi-
  leges, in relation to the effectiveness thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subdivision 19 of section 246 of chapter 81 of the laws of
1995, amending the vehicle and traffic law and other  laws  relating  to
the enforcement of support through the suspension of driving privileges,
as  amended by section 1 of part R of chapter 57 of the laws of 2009, is
amended to read as follows:
  19. Sections two hundred one, two hundred eight, two  hundred  eleven,
two  hundred  thirteen,  two  hundred fifteen and two hundred sixteen of
this act shall expire and be deemed repealed on June 30, [2011] 2013.
  S 2. This act shall take effect immediately and  shall  be  deemed  to
have been in full force and effect on and after June 30, 2011.
