TITLE OF BILL:
An act
to amend chapter 158 of the laws of 1988 relating to establishment
of a library district in the town of Hurley, Ulster county, in relation
to changing the hours of the library's annual election and the
organization of the board of trustees

PURPOSE OF THE BILL:
This bill would establish that the polls at the West Hurley public
library are to remain open from four o'clock p.m. until eight o'clock
p.m. for the receipt of ballots at all elections and that the number
of members managing and controlling the board of trustees is to
consist of seven to eleven members, as the board deems necessary.

SUMMARY OF SPECIFIC PROVISIONS:
* Section 1 amends paragraph (c) of subdivision 1 of section 2 of
chapter 158 of the laws of 1988.

* Section 2 amends section 3 of chapter 158 of the laws of 1988.

* Section 3 states the effective date.

JUSTIFICATION:
The West Hurley Public Library has requested this amendment to their
charter to encourage a higher voter turnout during the library's
annual election. Currently, the polling hours at the West Hurley
Public Library are from 7 p.m. until 10 p.m. These late hours
dissuade many from coming out and voting. Adjusting polling hours to
a more convenient 4 p.m. through 8 p.m. would encourage greater
citizen participation.

In addition, the West Hurley Library has determined that seven
trustees can adequately govern its current district size. This
legislation provides the board with the option to expand the number
of members up to eleven individuals, if deemed necessary, to fit the
needs of special projects.

  AN ACT to amend chapter 158 of the laws of 1988 relating  to  establish-
    ment  of  a  library district in the town of Hurley, Ulster county, in
    relation to changing the hours of the library's  annual  election  and
    the organization of the board of trustees

    THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section 1. Paragraph (c) of subdivision 1 of section 2 of chapter  158
  of  the laws of 1988, relating to establishment of a library district in
  the town of Hurley, Ulster county, is amended to read as follows:

    (c) the election of [three]  trustees  as  hereinafter  provided.  The
  trustees  of  the West Hurley library shall give notice of said election
  by the publication of a notice in one or more newspapers having a gener-
  al circulation in the district to be served. The  first  publication  of
  such notice shall be not less than thirteen days and not more than twen-
  ty  days  prior  to the date of such election. In addition, the board of
  trustees of the West Hurley library shall cause copies of such notice to
  be posted conspicuously in five public places in the district  at  least
  thirteen  days  prior  to  the  date of such election. Such notice shall
  specify the time when and the place where such election  will  be  held,
  the issues to be decided at said election and the hours during which the
  polls  will be open for receipt of ballots. The board of trustees of the
  West Hurley library shall prepare the ballots for such elections and the
  polls shall remain open for the receipt thereof at  all  elections  from
  [seven] FOUR o'clock p.m. until [ten] EIGHT o'clock p.m., and such addi-
  tional  consecutive  hours prior thereto as the board of trustees of the
  West Hurley library may have determined  and  specified  in  the  notice
  thereof.  The  board  of trustees shall designate a resident taxpayer of
  such district to act as chairman of any election of  such  district  and
  shall  designate not less than two nor more than four resident taxpayers

  to act as election inspectors and ballot clerks at  such  elections.  No
  trustees  shall  serve  as  such chairman or as an election inspector or
  ballot clerk. The board of trustees may  adopt  a  resolution  providing
  that  such chairman, election inspectors and ballot clerks shall be paid
  for their respective services at the initial election or at  any  annual
  election  or  at  any  subsequent  special election. Such resolution, if
  adopted, may fix reasonable compensation for the services of  each  such
  official.  Every  voter  of the first, third, fifth and seventh election
  district of the town of Hurley otherwise qualified to vote at a  general
  town  election  shall  be  qualified to vote at said election. After the
  polls have been closed at said election,  the  election  inspectors  and
  ballot  clerks  shall  immediately canvass publicly the ballots cast and
  the chairman of the election shall publicly announce the result.  Within
  seventy-two  hours  thereafter,  the  chairman,  election inspectors and
  ballot clerks shall execute and file a certificate of the result of  the
  canvass  with  the board of trustees and with the town clerk of the town
  of Hurley.
    S 2. Section 3 of chapter 158 of the laws of 1988, relating to  estab-
  lishment  of a library district in the town of Hurley, Ulster county, is
  amended to read as follows:

    S 3. Organization  and  structure.  The  West  Hurley  public  library
  district  shall  be managed, operated and controlled by a board of trus-
  tees consisting of [nine] SEVEN TO ELEVEN members. These trustees  shall
  at  the  first regular meeting of the board determine by lot the year in
  which each of their terms of office expire, [and the terms shall  expire
  as  follows:  After  one  year - three trustees; after two years - three
  trustees; after three years - three  trustees]  WITH  ONE-THIRD  OF  THE
  BOARD  EXPIRING  EACH YEAR. As vacancies occur trustees shall be elected
  at the annual election herein provided for to serve for three year terms
  by the voters of the library district  hereby  created,  said  terms  to
  commence  on  the first day of October next following the election. Only
  qualified voters of the district shall be eligible for election  to  the
  board  of trustees. The board of trustees at its first meeting each year
  shall elect or appoint a  president  and  vice-president  who  shall  be
  members  of  the board and a clerk, treasurer and such other officers as
  they deem necessary. If the board so determines, the  offices  of  clerk
  and  treasurer  may  be  held  by individuals who are not members of the
  board of trustees, and in that event, these officers may, if  the  board
  so determines, receive compensation as fixed by resolution of the board.
    S 3. This act shall take effect immediately.
