BILL NUMBER:S408 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the siting and licensing of radioactive or hazardous waste disposal or transfer stations PURPOSE: To prohibit radioactive hazardous waste disposal or transfer stations from being sited within 1500 feet of school property. SUMMARY OF PROVISIONS: The environmental conservation law is amended by adding a new section 27-0111. JUSTIFICATION: In the past, New York state has been very irresponsible, allowing radioactive waste facilities to be sited next to or too close to places of concern, such as a public elementary school. If some sort of disaster would occur at this hazardous waste facility, something as serious as a fire, because of its proximity to the school, the results could be devastating. Especially, if the nearest fire house was recently closed due to budget cuts. Therefore, it is with responsibility that I introduce this legislation to not allow the siting and licensing of hazardous or radioactive waste disposal or transfer stations to be within 1500 feet of the boundary of any school property. LEGISLATIVE HISTORY: 2011/12: S.4448 2009/10: S.1432/A.5176 Veto 6813 FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediately.
