BILL NUMBER:S4089 TITLE OF BILL: An act to amend the education law, in relation to directing the board of trustees of the state university of New York to offer differential nonresident tuition charges to certain students who reside within three hundred miles of the state university of New York at Alfred, Fredonia or Potsdam; and providing for the repeal of such provisions upon the expi- ration thereof PURPOSE: To authorize the SUNY Board of Trustees to develop a pilot program to be used by SUNY Fredonia, SUNY Alfred, and SUNY Potsdam to effectively market these universities to residents of surrounding states. SUMMARY OF PROVISIONS: This bill adds a new subdivision (2) to section 355 of the Education law to direct that starting in the 2015-2016 academic year, the SUNY Board of Trustees adopt regulations to provide that out of state residents who are living within a 300 mile radius of the campuses of SUNY Fredonia, SUNY Alfred, or SUNY Potsdam would pay tuition and fees at a rate which is 1.5 times the in state tuition and fee rate. No more than 10% of the enrollment openings at each campus could be filled by out of state

Paragraph h of subdivision 2 of section 355 of the educa- tion law is amended by adding a new subparagraph 7-a to read as follows: (7-A) COMMENCING IN THE TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN ACADEMIC YEAR, THE STATE UNIVERSITY TRUSTEES SHALL ADOPT REGULATIONS PROVIDING THAT ANY STUDENT WHO IS NOT A RESIDENT OF THIS STATE, BUT RESIDES WITHIN THREE HUNDRED MILES OF THE CAMPUS OF THE STATE UNIVERSITY OF NEW YORK AT ALFRED, FREDONIA OR POTSDAM SHALL PAY TUITION AND FEES FOR MATRICULATION AT SUCH CAMPUS OF THE STATE UNIVERSITY AT A RATE WHICH IS ONE AND ONE-HALF TIMES THE RATE IMPOSED UPON STUDENTS WHO ARE RESI- DENTS OF THIS STATE. PROVIDED THAT, SUCH DIFFERENTIAL RATE SHALL BE OFFERED ONLY TO SUCH ELIGIBLE NONRESIDENT STUDENTS WHICH DO NOT EXCEED TEN PERCENT OF THE ENROLLMENT OPENINGS AT EACH SUCH CAMPUS. EACH STUDENT AFFORDED A DIFFERENTIAL RATE AT THE TIME OF HIS OR HER ENROLLMENT IN THEIR RESPECTIVE INSTITUTION, WHO IS DETERMINED TO BE IN GOOD STANDING, SHALL BE ELIGIBLE FOR SUCH DIFFERENTIAL RATE FOR UP TO FOUR YEARS FROM THE DATE OF HIS OR HER INITIAL ENROLLMENT. THE STATE UNIVERSITY TRUS- TEES SHALL PROMOTE AND MARKET THE AVAILABILITY OF THE DIFFERENTIAL TUITION AND FEES TO INDIVIDUALS WHO WOULD BE ELIGIBLE TO TAKE ADVANTAGE THEREOF. S 2. SUMMARY OF PROVISIONS: This bill adds new subparagraphs 4(a) to section 355 of the Education law. Section (4-a)directs that beginning in the 2016-2017 academic year, the SUNY Board of Trustees is authorized to designate selected state operated institutions of SUNY to allow eligible non-resident undergraduate students to pay separate tuition rates for attendance at those selected institutions,. Those regulations shall provide that eligible out of state residents would pay tuition and fees at a rate which is not less than 1.5 times the in state tuition and fee rate. No more than 10% of the enrollment openings at each eligible campus could be filled by out of state students who receive this rate. The program would run for a four year period. BILL NUMBER: S4089C TITLE OF BILL : An act to amend the education law, in relation to allowing eligible non-resident undergraduate students to pay separate tuition rates for attendance at certain institutions; and providing for the repeal of such provisions upon expiration thereof PURPOSE : Allows eligible non-resident undergraduate students to pay separate tuition rates for attendance at certain institutions. SUMMARY OF PROVISIONS : Section 1: Amends education law section 355(2)(h) to add a new subparagraph (4-a) which provides that in the 2017-2018 academic year and ending in the 2021-2022 academic year, the SUNY Board of Trustees may designate the Fredonia and Alfred State campuses to participate in a program allowing nonresident undergraduate students to participate in a program allowing nonresident undergraduate students to pay separate tuition rates at those institutions if the campuses agree they want to participate in the program. The institutions that participate in this program must consider factors such as out-of-state competition, current or projected levels of high school graduates within the institution's recruitment region and enrollment capacity and physical location of the institution.
