BILL NUMBER:S4100 TITLE OF BILL: An act to amend the education law, in relation to enabling public libraries to access employment preparation education (EPE) funds to provide adult literacy instruction PURPOSE: The bill would allow public libraries to apply for and receive Employment preparation Education (EPE) funds for pre-GED and other adult literacy services authorized under the program. SUMMARY OF PROVISIONS: Subdivision 11 of Section 3602 of the Education Law is amended by adding a new paragraph a-2 that would set aside $3 million or the unspent remainder of the previous school year's appropriation, whichever is more, to be provided in competitive grants to public libraries, with at least half the amount set aside for libraries serving a population of one million or more. JUSTIFICATION: The employment Preparation Education (EPE) program (funded at $96 million) is currently only available to schools and BOCES to provide educational services to persons twenty-one years of age or older who have dropped out of high school and did not receive their degree or GED. These educational services include employment skills, English as a Second Language courses, pre-GED classes, etc. Libraries provide many of the same educational services like pre-GED courses, ESL classes, computer and internet skills, job readiness workshops and financial literacy classes, and yet they are not eligible to even apply for these EPE funds (which currently exceed the amount of Library Aid by almost $20 million). In addition, taking these courses at the public library, where people of all ages are involved in a variety of educational programs, is less of a stigma to adults then returning to the school they dropped out from, and many libraries can provide other support services for young adults that can facilitate their employment opportunities. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: The act shall take effect on September 1st in the year after it has become law.

AN ACT to amend the education law, in relation to enabling public libraries to access employment preparation education (EPE) funds to provide adult literacy instruction THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 11 of section 3602 of the education law is amended by adding a new paragraph a-2 to read as follows:
A-2. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH A OF THIS SUBDIVI SION, THE COMMISSIONER SHALL SET ASIDE AN AMOUNT OF THREE MILLION DOLLARS OR THE UNSPENT REMAINDER OF THE PREVIOUS SCHOOL YEAR'S APPROPRI ATION FOR THIS PROGRAM, WHICHEVER IS MORE, TO BE AWARDED THROUGH A COMPETITIVE GRANT PROCESS TO PUBLIC LIBRARIES TO PROVIDE ANY OF THE SERVICES AUTHORIZED IN THIS SUBDIVISION. HOWEVER, NO LESS THAN HALF THE ANNUAL APPROPRIATION SHALL BE SET ASIDE FOR PUBLIC LIBRARIES SERVING A POPULATION OF ONE MILLION OR MORE. THE COMMISSIONER SHALL HAVE THE AUTHORITY TO ESTABLISH RULES AND REGULATIONS TO IMPLEMENT THE PROVISIONS OF THIS PARAGRAPH.
