BILL NUMBER:S4109 TITLE OF BILL: An act to amend the executive law, in relation to adding the 18 Mile Creek to the definition of inland waterways PURPOSE: This legislation will include the 18 Mile Creek in Erie County as one of New York State's major creeks, and for it to be considered an inland waterway. SUMMARY OF PROVISIONS: Section 1 amends paragraph (b) of subdivision 4 of section 911 of the executive law to include 18 Mile Creek among the state's major creeks. Section 2 establishes an effective date. JUSTIFICATION: 18 Mile Creek plays an important role in Erie County. It is home to a number of resident and migratory species, and is a vital component of the Erie County ecosystem.

PANEPINTO -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to adding the 18 Mile Creek to the definition of inland waterways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 4 of section 911 of the execu- tive law, as separately amended by chapters 265, 272, 298, 310 and 311 of the laws of 2014, is amended to read as follows: (b) the state's major rivers comprised of the Allegheny, Ausable, Battenkill, Black, Boquet, Canisteo, Chaumont (including Chaumont bay), Chemung, Cohocton, Delaware, Deer, Genesee, Grasse, Great Chazy, Hoosic, Hudson north of the federal dam at Troy, Indian, Little (in the Adiron- dack park), Little Ausable, Little Salmon (including north and south branches), Mad, Mettowee, Mohawk, Oswegatchie, Racquette, Sacandaga, Salmon, Saranac, Schroon, Susquehanna, Tioga, Tioughnioga, Wallkill and Buffalo rivers, 18 MILE CREEK LOCATED IN ERIE COUNTY and the north and middle branches of the Moose river; S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD07755-03-5

Paragraph (c) of subdivision 4 of section 911 of the exec- utive law, as amended by chapter 27 of the laws of 2014, is amended to read as follows: (c) the state's major creeks comprised of the 18 MILE CREEK LOCATED IN ERIE COUNTY, Bushkill, Cattaraugus, Cincinnati, East Kill, Esopus (including upper and lower branches), Fish (including east and west branches), Gooseberry, Little Sandy, Onondaga, Sandy, Schoharie, South Sandy, Oatka, Tonawanda, West Kill, Scajaquada, Wappinger and Wynants- kill; S 2.
