TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to terminal leave

PURPOSE: To provide an incentive for members of the New York Police Department and members of the New York City Fire Department to remain on active duty.

SUMMARY: This bill would add a new section 14-154 and 15-129 to the administrative code of the city of New York to allow members of the Police Department and Fire Department to receive terminal leave payment while continuing to serve.

JUSTIFICATION: Retaining veteran police officers, fire fighter and fire officers within the City ranks is a paramount concern to the State and constituencies of the City of New York. The New York City Police and Fire Departments continue to face an unprecedented wave of retirements. A large number of police officers, firefighters and fire officers are quickly approaching 20 years of active service, making them eligible for retirement. Thus, the departments are confronted with a significant loss of its most experienced officers. One way to allow veteran police officers, fire fighters and fire officers to continue working is to grant them the option of taking a cash payment in lieu of their terminal leave. This bill will provide an incentive to officers to remain on the job and provide additional months of public protection at no additional cost.

The administrative code of the city of New York is amended by adding a new section 14-154 to read as follows: S 14-154 TERMINAL LEAVE. NOTWITHSTANDING THE PROVISIONS OF ANY GENER- AL, SPECIAL OR LOCAL LAW, CODE, RESOLUTION OR CHARTER TO THE CONTRARY, MEMBERS OF THE NEW YORK CITY POLICE FORCE SHALL BE AFFORDED THE OPTION OF TAKING A MONETARY PAYMENT OF UP TO FIFTY PERCENT OF ACCRUED TERMINAL LEAVE AT THE RATE APPLICABLE ON THE DATE OF RETIREMENT. FURTHERMORE, ON REACHING THEIR TWENTIETH ANNIVERSARY, MEMBERS OF THE NEW YORK CITY POLICE DEPARTMENT SHALL HAVE THE OPTION OF UTILIZING TERMINAL LEAVE AS TIME OWED TO THE MEMBER. S 2. The administrative code of the city of New York is amended by adding a new section 15-129 to read as follows: S 15-129 TERMINAL LEAVE. NOTWITHSTANDING THE PROVISIONS OF ANY GENER- AL, SPECIAL OR LOCAL LAW, CODE, RESOLUTION OR CHARTER TO THE CONTRARY, MEMBERS OF THE NEW YORK CITY FIRE DEPARTMENT SHALL BE AFFORDED THE OPTION OF TAKING A MONETARY PAYMENT OF UP TO FIFTY PERCENT OF ACCRUED TERMINAL LEAVE AT THE RATE APPLICABLE ON THE DATE OF RETIREMENT.
