Regulates the sale and distribution of sports dietary supplements; defines sports dietary supplements as dietary supplements that are sold, marketed or distributed to enhance human physical performance or to increase a person's metabolism, but not including supplements in liquid form and containing caffeine; requires provision of information pamphlets with each sports dietary supplement; prohibits provision of sports dietary supplements to children under 18 years of age

BILL NUMBER:S4151 TITLE OF BILL: An act to amend the public health law, in relation to regulating the sale of sports dietary supplements PURPOSE: The purpose of the bill is to ban the purchase of sports supplements by those under the age of 18. The bill will also require that consumers receive a copy of a warning label when they purchase certain products. These warning labels will tell the purchaser whether the product contains banned ingredients as determined by certain sports and regulatory agencies as well as stating specific side effects and whether these product contain synthetic botanicals. This bill will protect those who are underage from the dangerous side effects of these sport supplements. Furthermore, as a result of loopholes and lax regulations in federal law consumers are not able to determine what they are putting into their body and what is in these products. This act does not affect the sales of caffeinated energy drinks currently classified as supplements. This act will ensure that consumers are getting accurate information about what they are consuming and the risks that come with it. SUMMARY OF PROVISIONS: Section 1: Amends the public health law to add a new article 2-B regarding Sports dietary supplements.

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to regulating the sale of sports dietary supplements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new article 2-B to read as follows: ARTICLE 2-B SPORTS DIETARY SUPPLEMENTS SECTION 290. DEFINITIONS. 291. DISCLOSURE; SPORTS DIETARY SUPPLEMENTS. 292. SALE OR DISTRIBUTION TO MINORS; PROHIBITION. 293. PENALTIES. S 290. DEFINITIONS. AS USED IN THIS ARTICLE, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: 1. "DIETARY SUPPLEMENT" MEANS A PRODUCT (OTHER THAN TOBACCO) THAT IS (A) INTENDED TO SUPPLEMENT THE DIET AND THAT BEARS OR CONTAINS ONE OR MORE OF THE FOLLOWING DIETARY INGREDIENTS: A VITAMIN, A MINERAL, AN HERB OR OTHER BOTANICAL, AN AMINO ACID, A DIETARY SUBSTANCE FOR THE USE BY A PERSON TO SUPPLEMENT THE DIET BY INCREASING THE TOTAL DAILY INTAKE, OR A CONCENTRATE, METABOLITE, CONSTITUENT, EXTRACT OR COMBINATIONS OF THESE INGREDIENTS; (B) INTENDED FOR INGESTION IN PILL, CAPSULE, TABLET OR LIQUID FORM; AND (C) LABELED AS A "DIETARY SUPPLEMENT" PURSUANT TO THE FEDERAL DIETARY SUPPLEMENT HEALTH AND EDUCATION ACT, 21 U.S.C. 321, AS AMENDED. 2. "SPORTS DIETARY SUPPLEMENT" MEANS A DIETARY SUPPLEMENT, HAVING MORE THAN ONE INGREDIENT, WHICH IS SOLD, MARKETED OR DISTRIBUTED TO ENHANCE A PERSON'S PHYSICAL PERFORMANCE OR TO INCREASE A PERSON'S METABOLISM; PROVIDED, HOWEVER, THAT SUCH TERM SHALL NOT INCLUDE ANY DIETARY SUPPLE- MENT IN LIQUID FORM AND CONTAINING CAFFEINE.
