BILL NUMBER:S4158 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to agriculture and farmland protection programs PURPOSE OR GENERAL IDEA OF BILL: Would include efforts to support transfer of farmland to beginning farmers as part of local government farmland protection programs. SUMMARY OF SPECIFIC PROVISIONS: The bill would amend sections 324 and 324-a of the Agriculture and Markets Law by amending county and municipal farmland protection provisions to encourage efforts to support transfer of farmland to new owners, especially beginning farmers. JUSTIFICATION: The most recent federal census of agriculture in 2007 found that the average age of farmers in NYS is about 56, up from 50 in the early 1980s. The U.S. Secretary of Agriculture has set a goal of recruiting 100,000 new farmers across the country to replace those that are retiring or leaving. PANEPINTO -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to agricul- ture and farmland protection programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 1 of section 324 of the agri- culture and markets law, as added by chapter 797 of the laws of 1992, is amended to read as follows: (c) a description of the activities, programs and strategies, INCLUD- ING EFFORTS TO SUPPORT THE SUCCESSFUL TRANSFER OF AGRICULTURAL LAND FROM EXISTING OWNERS TO NEW OWNERS AND OPERATORS, ESPECIALLY NEW AND BEGIN- NING FARMERS, intended to be used by the county to promote continued agricultural use, WHICH MAY INCLUDE BUT NOT BE LIMITED TO REVISIONS TO THE COUNTY'S COMPREHENSIVE PLAN PURSUANT TO SECTION TWO HUNDRED THIRTY- NINE-D OR TWO HUNDRED THIRTY-NINE-I OF THE GENERAL MUNICIPAL LAW. S 2. Paragraph (c) of subdivision 1 of section 324-a of the agricul- ture and markets law, as added by chapter 527 of the laws of 2005, is amended to read as follows: (c) a description of activities, programs and strategies, INCLUDING EFFORTS TO SUPPORT THE SUCCESSFUL TRANSFER OF AGRICULTURAL LAND FROM EXISTING OWNERS TO NEW OWNERS AND OPERATORS, ESPECIALLY NEW AND BEGIN- NING FARMERS, intended to be used by the municipality to promote contin- ued agricultural use, which may include but not be limited to revisions to the municipality's comprehensive plan pursuant to [paragraph (a) of subdivision two of] section two hundred seventy-two-a of the town law [and land use regulations as defined in paragraph (b) of subdivision two of section two hundred seventy-two-a of the town law] OR SECTION 7-722 OF THE VILLAGE LAW as appropriate.
