BILL NUMBER:S4181 TITLE OF BILL: An act to amend the penal law, in relation to increasing the threshold dollar amount of property damage needed to be committed for the crimes of criminal mischief in the fourth and third degrees PURPOSE: To raise the threshold amount of property damage for criminal mischief in the third degree from $250 to $500. SUMMARY OF PROVISIONS: Section 1 amends subdivision 3 of section 145.00 of the penal law to increase the threshold amount for criminal mischief in the fourth degree to $500. Section 2 amends subdivision 2 of section 145.05 of the penal law to increase the threshold amount for criminal mischief in the third degree to $500. Section 2 sets the effective date. JUSTIFICATION:

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to increasing the threshold dollar amount of property damage needed to be committed for the crimes of criminal mischief in the fourth and third degrees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 145.00 of the penal law, as amended by chapter 69 of the laws of 2008, is amended to read as follows: 3. Recklessly damages property of another person in an amount exceed- ing [two] FIVE hundred [fifty] dollars; or S 2. Subdivision 2 of section 145.05 of the penal law, as amended by chapter 276 of the laws of 2003, is amended to read as follows: 2. damages property of another person in an amount exceeding [two] FIVE hundred [fifty] dollars. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09747-01-5
