TITLE OF BILL: An act to amend the education law, in relation to authorizing the Ogdensburg city school district to operate as if it were a central school district

PURPOSE: To allow the Ogdensburg school district to utilize the provisions allowed for central school districts for purposes of consolidation with other school districts.

SUMMARY OF PROVISIONS:

Section one provides that, notwithstanding that the Ogdensburg central school district is classified as a small city school district under the education law, it will have the option of using the organizational procedure allowed for central school districts under article thirty-seven of the law, for purposes of consolidation with other districts.

Section two provides the effective date of the legislation.

EXISTING LAW: Under current law, Ogdensburg is considered to be a small city school district, and as such, in order to consolidate with other school district, it must use a procedure that is more akin to an annexation. Under Article thirty-seven of the Education law, Central school districts are able to use a true consolidation process.

JUSTIFICATION: The Ogdensburg central school district is attempting to operate more efficiently by entering into consolidation discussions with surrounding school districts. However, as a small city school district, the process it is allowed to use is similar to annexation, rather than consolidation

Ogdensburg simply wants the opportunity to be able to use the consolidation process allowed to central school districts, as allowed by article thirty-seven of the education law.

This bill would pertain solely to the Ogdensburg school district.

LEGISLATIVE HISTORY: This is a new bill.

FISCAL IMPLICATIONS: None to state. If the consolidation process is made more palatable for Ogdensburg and other nearby districts, they may be more likely to combine, thereby operating more efficiently and saving costs.

EFFECTIVE DATE: If enacted, this bill would take effect immediately.

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to authorizing the Ogdensburg city school district to operate as if it were a central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1524 of the education law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING THE PROVISIONS OF THIS SECTION, THE OGDENSBURG CITY SCHOOL DISTRICT SHALL HAVE THE OPTION OF USING THE ORGANIZATION PROCE- DURE ALLOWED FOR CENTRAL SCHOOL DISTRICTS UNDER ARTICLE THIRTY-SEVEN OF THIS TITLE. S 2. This act shall take effect immediately.
