BILL NUMBER:S4211 TITLE OF BILL: An act to amend the education law, in relation to allowing certain schools to contract with BOCES for criminal background checks PURPOSE OR GENERAL IDEA OF BILL: This bill would allow non-public schools to enter into contracts with BOCES schools for the processing of fingerprints in relation to criminal background checks. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends the education law to allow non-public schools to enter into contracts with BOCES schools for the processing of fingerprints in relation to criminal background checks. JUSTIFICATION: Current law allows non-public schools to contract with BOCES to process pupil personnel records but not to process background checks for teachers. Allowing these schools to contract with BOCES to process fingerprints and criminal background checks would ensure the safety of students. The state must make that all teachers have been properly screened. Non-public schools will pay the costs.

NOLAN, CUSICK -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to allowing certain schools to contract with BOCES for criminal background checks THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 4 of paragraph h of subdivision 4 of section 1950 of the education law, as added by chapter 113 of the laws of 1972, is amended to read as follows: (4) To enter into contracts with nonpublic schools to provide data processing [service] SERVICES for pupil personnel records and other administrative records of the nonpublic schools AND THE PROCESSING OF FINGERPRINTS UTILIZED IN CRIMINAL HISTORY RECORD CHECKS FOR THOSE NONPUBLIC SCHOOLS THAT ELECT TO REQUIRE SUCH CRIMINAL HISTORY RECORD CHECKS PURSUANT TO PARAGRAPH (A) OF SUBDIVISION THIRTY OF SECTION THREE HUNDRED FIVE OF THIS CHAPTER.
