BILL NUMBER:S4237 TITLE OF BILL: An act to amend the tax law, in relation to vendor fees at certain vendor tracks PURPOSE: This bill increases vendor fees to the facilities located in the Finger Lakes, Batavia, Hamburg. SUMMARY OF PROVISIONS: Amends section 1612 of the tax law to increase vendor fees at certain vendor tracks. JUSTIFICATION: Western New York Racinos are a strong economic driver for local economies that also provide critical revenue for county governments throughout the region. As such, it is vitally important that the state act to increase vendor fees to the facilities located in the Finger Lakes, Batavia and Hamburg. These changes will allow Western New York Racinos the kind of economic certainty that is needed to not only retain their current workforce, but also to seriously contemplate expansion. GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wager- ing AN ACT to amend the tax law, in relation to vendor fees at certain vendor tracks THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (ii) of paragraph 1 of subdivision b of section 1612 of the tax law is amended by adding a new clause (G-2) to read as follows: (G-2) NOTWITHSTANDING CLAUSES (A), (B), (C), (D), (E) AND (F) OF THIS SUBPARAGRAPH, A VENDOR TRACK LOCATED WITHIN REGION SIX OF DEVELOPMENT ZONE TWO AS DEFINED BY SECTION THIRTEEN HUNDRED TEN OF THE RACING, PARI-MUTUEL WAGERING AND BREEDING LAW SHALL RECEIVE A VENDOR FEE AT A RATE OF SIXTY-FIVE PERCENT OF THE TOTAL REVENUE WAGERED AT THE VENDOR TRACK AFTER PAYOUT OF PRIZES PURSUANT TO THIS CHAPTER; S 2. Clause (D) of subparagraph (ii) of paragraph 1 of subdivi- sion b of section 1612 of the tax law, as amended by chapter 174 of the laws of 2013, is amended to read as follows: (D) notwithstanding clauses (A), (B) and (C) of this subparagraph, when the vendor track is located within [fifteen] FORTY miles of a Native American class III gaming facility at a rate of forty-one percent of the total revenue wagered at the vendor track after payout for prizes pursuant to this chapter; S 2.
