BILL NUMBER:S4277 TITLE OF BILL: An act to amend the public health law, in relation to requiring local health departments to notify volunteer fire companies upon detecting radiation PURPOSE OR GENERAL IDEA OF BILL: To require local health departments to notify volunteer fire companies when they find radiation at a location the fire company serves. SUMMARY OF SPECIFIC PROVISIONS: Section 1 requires county departments of health, local boards of health or any other office of a municipality to provide notice to any fire company, serving any location, facility, site, building or residence, where such entity found traces of radiation. Requires notice to: be provided in writing within five days of such finding, contain specific details of radioactive samples found, including level of radiation and level of public health threat, and contain any recommendations for dealing with the radioactive materials in a safe and sufficient matter during firefighting operations. Also, requires the commissioner of health to promulgate rules and regulations to implement these requirements. Section 2 contains the effective date.

CROCI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring local health departments to notify volunteer fire companies upon detecting radiation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 13 of the public health law is amended by adding a new title 12-B to read as follows: TITLE 12-B NOTIFICATION TO VOLUNTEER FIRE COMPANIES OF THE DETECTION OF RADIATION SECTION 1389-H. NOTIFICATION TO VOLUNTEER FIRE COMPANIES OF THE DETECTION OF RADIATION. S 1389-H. NOTIFICATION TO VOLUNTEER FIRE COMPANIES OF THE DETECTION OF RADIATION. COUNTY DEPARTMENTS OF HEALTH, LOCAL BOARDS OF HEALTH AND ANY OTHER OFFICE OF A MUNICIPALITY AS DEFINED BY THIS CHAPTER SHALL PROVIDE NOTICE TO ANY FIRE COMPANY, AS DEFINED BY SUBDIVISION TWO OF SECTION ONE HUNDRED OF THE GENERAL MUNICIPAL LAW, SERVING ANY LOCATION, FACILITY, SITE, BUILDING OR RESIDENCE, WHERE SUCH ENTITY FINDS TRACES OF RADI- ATION. SUCH NOTICE, SHALL BE PROVIDED WITHIN FIVE DAYS OF SUCH FINDING, SHALL CONTAIN SPECIFIC DETAILS OF RADIOACTIVE SAMPLES FOUND, INCLUDING LEVEL OF RADIATION AND LEVEL OF PUBLIC HEALTH THREAT, AND SHALL CONTAIN ANY RECOMMENDATIONS FOR DEALING WITH THE RADIOACTIVE MATERIALS IN A SAFE AND SUFFICIENT MANNER DURING FIREFIGHTING OPERATIONS. THE COMMISSIONER SHALL PROMULGATE SUCH RULES AND REGULATIONS AS MAY BE NECESSARY TO EFFECTUATE THE PROVISIONS OF THIS SECTION. S 2. This act shall take effect on the ninetieth day after it shall have become a law; provided that the commissioner of health is author- ized to promulgate any rules and regulations necessary to implement this act on or before its effective date.
