BILL NUMBER:S4278 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to exempting fire vehicles from the weight restrictions of other vehicles PURPOSE: This bill would allow fire departments to legally operate apparatus being used for the purpose of public safety, but which violate New York's weight restrictions SUMMARY OF PROVISIONS: Section 1. Adds a new subdivision 23 to section 385 of the vehicle and traffic law to exempt fire vehicles from the weight restrictions of other vehicles Section 2 is the effective date. JUSTIFICATION: New York is one of only several states which do not specifically exempt fire vehicles from weight restrictions under the vehicle and traffic law. This has caused fire departments to either knowingly disregard the laws to operate necessary emergency vehicles or purchase vehicles that are inadequate in order to adhere to the legal weight restrictions. Currently, an average tandem axle Tower Ladder will weigh approximately 80,000 pounds. These vehicles are being operated out of compliance on a daily basis.
