BILL NUMBER:S4369 TITLE OF BILL: An act to amend the education law, in relation to authorizing the Yonkers city school district to require certain minors who are five years of age to attend kindergarten PURPOSE: To permit the Yonkers School District to require kindergarten attendance. SUMMARY OF PROVISIONS: This bill amends Education Law to allow the Yonkers School District to require attendance in kindergarten. JUSTIFICATION: The Yonkers Public Schools currently provide children a full day kindergarten program in keeping with the numerous studies documenting the educational benefit and related long-term success of early quality education. Unfortunately, too many kindergarten children are absent from school during the year, leaving them without the benefit of this educational experience. The Yonkers Board of Education recently adopted a resolution recognizing the importance of kindergarten as part of the educational process and requesting the authority to require kindergarten attendance. The resolution notes that "....enumerable studies have documented the value to children of beginning the educational process at an early age in order to prepare them for a life of learning, work and active engagement in society."

STEWART-COUSINS, LATIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Educa- tion AN ACT to amend the education law, in relation to authorizing the Yonk- ers city school district to require certain minors who are five years of age to attend kindergarten THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph c of subdivision 2 of section 3205 of the educa- tion law, as separately amended by chapters 187 and 189 of the laws of 2014, is amended to read as follows: c. The board of education of the Syracuse city school district [and], the board of education of the city school district of the city of New York, the board of education of the city school district of the city of Rochester [and], the board of education of the city school district of the city of Utica [and], the board of education of the city school district of the city of Buffalo AND THE BOARD OF EDUCATION OF THE CITY SCHOOL DISTRICT OF THE CITY OF YONKERS are hereby authorized to require minors who are five years of age on or before December first to attend kindergarten instruction. However, the provisions of this paragraph shall not apply to: (i) Minors whose parents elect not to enroll their children in school until the following September. (ii) Students enrolled in non-public schools or in home instruction. S 2. This act shall take effect immediately.
