BILL NUMBER:S4406 TITLE OF BILL: An act to amend the education law, in relation to school aid for the installation of alternative energy PURPOSE: To allow school district to receive building aid for the installation of alternative system SUMMARY OF PROVISIONS: Section 3602 of the Education law is amended to allow school districts to receive building aid for the installation of alternative energy systems, including solar, wind or geothermal projects. Section 2- contains the effective date JUSTIFICATION: This legislation would modify the Education law to allow school districts to receive building aid for the installation of alternative energy system, including solar, wind or geothermal project. Currently, school districts can receive building aid for the installation of apparatus that support these alternative systems, including pumps, wiring, controls. MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to school aid for the installation of alternative energy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3602 of the education law is amended by adding a new subdivision 6-h to read as follows: 6-H. ADDITIONAL APPORTIONMENT OF BUILDING AID FOR INSTALLATION OF ALTERNATIVE ENERGY, INCLUDING SOLAR, WIND OR GEOTHERMAL. IN ADDITION TO APPORTIONMENTS PAYABLE TO A SCHOOL DISTRICT PURSUANT TO SUBDIVISION SIX OF THIS SECTION, THE COMMISSIONER IS HEREBY AUTHORIZED TO APPORTION TO ANY SCHOOL DISTRICT ADDITIONAL BUILDING AID IN ACCORDANCE WITH THIS SUBDIVISION FOR ITS APPROVED EXPENSES IN THE BASE YEAR FOR THE INSTALLA- TION OF ALTERNATIVE ENERGY, INCLUDING SOLAR, WIND OR GEOTHERMAL. THE AMOUNT OF SUCH APPORTIONMENT SHALL EQUAL THE PRODUCT OF THE BUILDING AID RATIO DEFINED PURSUANT TO PARAGRAPH C OF SUBDIVISION SIX OF THIS SECTION AND THE ACTUAL APPROVED EXPENSES INCURRED BY THE DISTRICT IN THE BASE YEAR FOR EACH SCHOOL BUILDING MAKING SUCH INSTALLATION, PROVIDED THAT THE AMOUNT OF SUCH APPORTIONMENT SHALL NOT EXCEED THE INSTALLATION OF SUCH ALTERNATIVE ENERGY.
