BILL NUMBER:S4456

TITLE OF BILL: An act to amend the general business law, in relation to eliminating the requirement under the security guard act of full-time employment for peace officers

PURPOSE:

To allow Auxiliary Police, who are part-time Peace Officers, to qualify for a security guard training waiver.

SUMMARY:

Section 1. Subdivision 14 of Section 89-f of the General Business Law as amended by Chapter 634 of the laws of 1994, is amended to eliminate the requirement of full-time employment for Peace Officers.

JUSTIFICATION:

Auxiliary Police are volunteer, part-time Peace Officers. Under current law, only full-time Peace Officers qualify for a training waiver to become a Security Guard. The requirement to be employed full-time as a Peace Officer dates back to when the training for part-time Peace Officers was different than the training for full-time Peace Officers. However, training for Peace Officers is now the same for all Peace Officers as is found in the Criminal Procedure Law, subdivision one of section 2.30. The training of all Peace Officers exceeds the training requirements for a Security Guard. By eliminating the requirement of full-time employment for Peace Officers, this bill would allow the Division of Criminal Justice Services to issue the same training waiver to become a Security Guard, to part-time Peace Officers that is currently issued to full-time Peace Officers.

LEGISLATIVE HISTORY:

New bill.

FISCAL IMPACT:

There is no fiscal impact to any government.

EFFECTIVE DATE:

Immediately
