BILL NUMBER:S4485 TITLE OF BILL: An act to amend the general business law, in relation to health clubs providing automated external defibrillators on site during staffed operating hours PURPOSE OR GENERAL IDEA OF BILL: This bill clarifies the General Business Law to provide that persons trained in AED use must be on the premises of a health club during staffed hours. SUMMARY OF SPECIFIC PROVISIONS: Section one - amends subdivision one of section 627 -a of the General Business Law by changing the business hours during which an employee or volunteer in a health club must be trained in AED use to staffed business hours. Section two - provides the effective date. JUSTIFICATION: This legislation amends the General Business Law to address the issue of AEDs in health clubs to clarify that an employee or authorized volunteer of such health club who has been trained in the administration of CPR and an AED only need be present at the club during staffed business hours. This resolves any ambiguity regarding liability claims that might arise when a club is open but is not "staffed." Some health clubs are accessible to patrons during non-staffed business hours. PRIOR LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATION: None to the state. EFFECTIVE DATE: Immediately.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 1 of section 627-a of the general business law, as added by chapter 186 of the laws of 2004, is amended to read as follows:
1. Every health club as defined under paragraph b of subdivision one of section three thousand-d of the public health law whose membership is five hundred persons or more shall have on the premises at least one automated external defibrillator and shall have in attendance, at all times during STAFFED business hours, at least one individual performing employment or individual acting as an authorized volunteer who holds a valid certification of completion of a course in the study of the opera tion of AEDs and a valid certification of the completion of a course in the training of cardiopulmonary resuscitation provided by a nationally recognized organization or association.
