TITLE OF BILL: An act to amend the correction law, in relation to in-person appearance requirements for level two sex offenders

PURPOSE:

Increases the in-person appearance requirements for level two sex offenders.

SUMMARY OF PROVISIONS:

The correction law is amended by adding section 2 of part 0 of chapter 56.

JUSTIFICATION:

Sex offenders must register with law enforcement by mail on a yearly basis, but level three offenders must also appear in person at the law enforcement agency each year with a current photograph. Level two offenders, however, must only appear in person and submit such a photograph every three years. Because level two offenders have also committed serious offenses and because it is equally important that law enforcement be secure in the knowledge that they are located at the address given on the mail-in form and that their appearance has not significantly changed, it is important to require level two offenders to appear in person every year. A yearly visit is not an onerous burden for the offender, and it is an important safety measure for society to know that a current photograph of offenders is on record with law enforcement.

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to in-person appearance requirements for level two sex offenders THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (b-2) and (b-3) of subdivision 2 of section 168-f of the correction law, as added by section 2 of part O of chapter 56 of the laws of 2005, are amended to read as follows: (b-2) If the sex offender has been given a level TWO OR LEVEL three designation, he or she shall personally appear at the law enforcement agency having jurisdiction within twenty days of the first anniversary of the sex offender's initial registration and every year thereafter during the period of registration for the purpose of providing a current photograph of such offender. The law enforcement agency having jurisdic- tion shall photograph the sex offender and shall promptly forward a copy of such photograph to the division. For purposes of this paragraph, if such sex offender is confined in a state or local correctional facility, the local law enforcement agency having jurisdiction shall be the ward- en, superintendent, sheriff or other person in charge of the state or local correctional facility. (b-3) If the sex offender has been given a level one [or level two] designation, he or she shall personally appear at the law enforcement agency having jurisdiction within twenty days of the third anniversary of the sex offender's initial registration and every three years there- after during the period of registration for the purpose of providing a current photograph of such offender. The law enforcement agency having jurisdiction shall photograph the sex offender and shall promptly forward a copy of such photograph to the division. For purposes of this paragraph, if such sex offender is confined in a state or local correc-
tional facility, the local law enforcement agency having jurisdiction shall be the warden, superintendent, sheriff or other person in charge of the state or local correctional facility. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
