BILL NUMBER:S4516 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to increasing the fines for dumping snow onto handicapped parking places PURPOSE: Provides that anyone who knowingly dumps or shovels snow onto parking places for handicapped people shall be subject to a fine. SUMMARY OF PROVISIONS: Section one of the bill amends vehicle and traffic law section 1203-e to read that any person who knowingly dumps or shovels snow into a handicapped Parking space shall be subject to a fine of one and fifty dollars for the first offense and a fine not exceeding three hundred dollars for the second fine. Section one also allows for local or municipal governments to establish higher fines. However these fines cannot exceed two hundred and fifty dollars on the first offense and five hundred dollars on the second offense. JUSTIFICATION: In the 2010-2011 winter, New York state suffered a number of snow storms. As a result of the accumulating snow, many handicapped parking spaces became unavailable. The local code enforcement agencies had to issue numerous tickets to violators dumping snow into these areas. The law right now states that the fine for the first offense cannot exceed fifty dollars, increasing this fine would act as a deterrent to would be violators. LEGISLATIVE HISTORY: This is a new bill. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the vehicle and traffic law, in relation to increasing the fines for dumping snow onto handicapped parking places
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 1203-e of the vehicle and traffic law, as amended by chapter 65 of the laws of 1996, is amended to read as follows:
S 1203-e. Dumping snow onto parking places for handicapped prohibited. Any person who knowingly dumps or shovels snow onto a parking place for handicapped persons rendering such place unusable for parking purposes shall be subject to a fine of [twenty-five] ONE HUNDRED FIFTY dollars for the first offense and a fine not to exceed [one] THREE hundred dollars for every offense thereafter. However, a local or municipal government may, by local law or ordinance, establish fines higher than those established in this section, but in no instance shall the fines exceed TWO HUNDRED fifty dollars for the first offense or [two] FIVE hundred dollars for the second or subsequent offense.
