TITLE OF BILL: An act to amend the tax law, in relation to the imposition of additional sales and compensating use tax in Fulton county

PURPOSE:

To extend, for another two years, the authority of Fulton County to impose an additional sales and use tax of one percent.

SUMMARY OF PROVISIONS:

Section 1210 of the Tax Law is amended to extend, until November 30, 2015, the authority of Fulton County to impose a sales and use tax which is one percent additional to the three percent rate that is generally authorized by state law.

EXISTING LAW:

Section 1210 of the Tax Law currently authorizes Fulton County to impose the additional one percent sales and use tax until November 30, 2013.

JUSTIFICATION:

In 2005, the Fulton County Board of Supervisors requested legislation to impose an additional 1% sales tax in order to help diversify its revenue sources and thereby help alleviate the property tax burden. This authority was initially granted for two years, and was renewed in 2007, 2009 and 2011. These sales tax revenues are a necessary part of the County's financial plan, and this bill would extend, for another two years, the authority of Fulton County to impose this additional sales tax.

FISCAL IMPLICATIONS:

None to the State.

LOCAL FISCAL IMPLICATIONS:

This bill will continue the current level of local sales tax revenue received by Fulton County.

EFFECTIVE DATE:

Immediate.

BUTLER -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to the imposition of additional sales and compensating use tax in Fulton county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause 39 of subparagraph (i) of the opening paragraph of section 1210 of the tax law, as amended by chapter 236 of the laws of 2011, is amended to read as follows: (39) the county of Fulton is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate which is one percent additional to the three percent rate authorized above in this paragraph for such county for the period beginning September first, two thousand five, and ending November thir- tieth, two thousand [thirteen] FIFTEEN; S 2. This act shall take effect immediately.
