Commencing with the proposed budget for the 2012-2013, the property tax report card shall be mailed to all qualified voters of the school district after the date of the budget hearing, but no later than six days prior to the annual meeting and election or special district meeting at which a school budget vote will occur; provided further that commencing with the proposed budget for the 2012-2013 school year, all documents prepared by the board of education and/or school district that inform the public, whether by electronic, hardcopy, or other means, about proposed tax rate increases or decreases, and/or percentage increases or decreases, resulting from a proposed budget, shall include the proposed budget increase or decrease, and percentage increase or decrease, and the proposed tax levy increase or decrease, and percentage increase or decrease, on the same page, and in the same font style and size, as the proposed tax rate change.

BILL NUMBER:S466A TITLE OF BILL: An act to amend the education law, in relation to requiring tax levy information and percentage increase to be sent to all voters PURPOSE: Requires tax levy and percentage increase to be sent to all voters. SUMMARY OF SPECIFIC PROVISIONS: Sections 1 and 2 paragraph a of subdivision 2-a of section 2022 of the education law, proposes that any increase of the tax levy within the two-thousand seven--two thousand eight school year be included in projected contingency budget. Section 3 amends sections 1716 of the education law adding two new subdivisions 8 and 9. This would require school districts to mail a tax report card to all qualified voters of the school district. Section 4 amends section 1608 of the education law by adding subdivisions 8 and 9. These amendments require that the cards be mailed no later than six days prior to the annual meeting and election. JUSTIFICATION: Constituents who face the burden of increased taxes deserve a period to bring forth their concerns regarding tax levy information to the board of trustees for a school district. The mailing of an informational tax card with relevant information pertaining to the amount of increase or decrease of: student enrollment and the projected tax rate(s). Individuals responsible for controlling the tax rate will be held at a greater level of accountability to the tax paying public that the school district resides. PRIOR LEGISLATIVE HISTORY: S.5038 of 2007/2008 S.3272 of 2009/2010 FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect on the first of July next succeeding the date on which it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph a of subdivision 2-a of section 2022 of the
education law, as amended by section 7 of part A of chapter 97 of the
laws of 2011, is amended to read as follows:
a. Commencing with the proposed budget for the two thousand one--two
thousand two school year, such notice shall also include a description
of how total spending and the tax levy, AND, COMMENCING WITH THE
PROPOSED BUDGET FOR THE TWO THOUSAND TWELVE--TWO THOUSAND THIRTEEN
SCHOOL YEAR, THE PERCENTAGE INCREASE OR DECREASE IN THE TAX LEVY result-
ing from the proposed budget would compare with a projected contingency
budget adopted pursuant to section two thousand twenty-three of this
[article] PART, assuming that such contingency budget is adopted on the
same day as the vote on the proposed budget. Such comparison shall be in
total and by component (program, capital and administrative), and shall
include a statement of the assumptions made in estimating the projected
contingency budget.
S 2. Paragraph a of subdivision 2-a of section 2022 of the education
law, as added by section 3 of part A of chapter 60 of the laws of 2000,
is amended to read as follows:
a. Commencing with the proposed budget for the two thousand one--two
thousand two school year, such notice shall also include a description

EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

S 5. This act shall take effect on the first of July next succeeding
the date on which it shall have become a law; provided, however, that
the amendments to paragraph a of subdivision 2-a of section 2022 of the
education law, made by section one of this act, shall be subject to the
expiration and reversion of such section pursuant to section 13 of part
A of chapter 97 of the laws of 2011, as amended, when upon such date the
provisions of section two of this act shall take effect; provided
further that effective immediately, the addition, amendment and/or
repeal of any rule or regulation necessary for the implementation of
this act on its effective date are authorized and directed to be made
and completed on or before such effective date.
