BILL NUMBER:S4693 TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating certain employees of the town of Brookhaven as peace officers PURPOSE: This would designate employees holding specific titles within the Town of Brookhaven's Department of Public Safety as peace officers. SUMMARY OF PROVISIONS: Section 1 amends Section 2.10 of the criminal procedure law by adding a new subdivision 84 granting peace officer status to employees of the Town of Brookhaven's Department of Public Safety that hold the titles of Commissioner, Deputy Commissioner, Secu- rity Director, and Assistant Security Director. JUSTIFICATION: This legislation, introduced at the request of the Town of Brookhaven, would grant peace officer status to employees of the Town of Brookhaven's Department of Public Safety that hold the titles of Commissioner, Deputy Commissioner, Security Director, and Assistant Security Director, when acting pursuant to their special duties. There is nothing in this subdivision that shall be deemed to authorize such employee to carry, possess, repair or dispose of a firearm unless the appropriate license has been issued pursuant to section 400.00 of the penal law. There are currently six employees, all non-uniformed adminis- trative and managerial personnel, who would qualify for said desig- nation.

THIELE, ENGLEBRIGHT, GARBARINO, GRAF, MURRAY, PALUMBO -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating certain employees of the town of Brookhaven as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 84 to read as follows: 84. EMPLOYEES OF THE TOWN OF BROOKHAVEN SERVING AS COMMISSIONER, DEPU- TY COMMISSIONER, SECURITY DIRECTOR, AND ASSISTANT SECURITY DIRECTOR IN THE DEPARTMENT OF PUBLIC SAFETY WHEN ACTING PURSUANT TO THEIR SPECIAL DUTIES PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSU- ANT TO SECTION 400.00 OF THE PENAL LAW.
