BILL NUMBER:S4897 TITLE OF BILL: An act to amend the public authorities law, in relation to the restriction and regulation of advertising devices PURPOSE OR GENERAL IDEA OF BILL: To amend the public authorities law regarding the erection of billboard signs in the City of New Rochelle along interstate route ninety-five. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends the public authorities law to allow for the erection of up to nine advertising billboard signs in the City of New Rochelle along interstate route ninety-five. Section 2 of the bill provides for an effective date. JUSTIFICATION: In 2000, the City of New Rochelle entered into a settlement agreement stemming from litigation in the matter of Universal Outdoor, Inc., et al v. City of New Rochelle (the Settlement Agreement) The Settlement Agreement stipulated that up to nine billboards could be erected in the 1-95 corridor in New Rochelle This legislation amends the public author- ities law to be consistent with the terms of the Settlement Agreement.

STEWART-COUSINS, LATIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Trans- portation AN ACT to amend the public authorities law, in relation to the restriction and regulation of advertising devices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 361-a of the public authorities law, as added by chapter 593 of the laws of 1952 and paragraph (d) as amended by chapter 169 of the laws of 2003, is amended to read as follows: 4. To effectuate the purposes of this section, the authority may limit the application of any regulation adopted hereunder to exclude or include, in whole or in part: (a) Specified areas of the thruway system based upon use, population density, nature of the surrounding community, special conditions prevailing therein, or such other factors as may make differentiation or separate classification or regulation necessary, proper or desirable; (b) Particular types or classes of advertising devices based upon size, design, lighting or such other factors as may make differentiation or separate classification or regulation necessary, proper or desirable; (c) The erection or maintenance of advertising devices on particular sections or portions of the thruway system. (d) Notwithstanding any contrary provisions of this section, the authority shall permit the erection of not more than [six] NINE adver- tising billboard signs in the city of New Rochelle along interstate route ninety-five where the location and erection of such signs are: (1) consistent with and part of an urban renewal program which decreases the total number of advertising billboard signs in the renewal area; (2) approved by such city; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
