TITLE OF BILL: An act to amend the public authorities law, in relation to the powers of the canal corporation
PURPOSE OR GENERAL IDEA OF BILL: Allows canal corporation to waive fee for work permit for project on canal lands if it adds value to lands at no cost to canal corporation or state.
SUMMARY OF SPECIFIC PROVISIONS: Adds a new paragraph (p) to Section 1 of subdivision 7 of section 382 of the public authorities law, as amended by chapter 138 of the laws of 1997.
JUSTIFICATION: This bill is being requested because of several eagle scouts being required to pay a $25 work permit fee for their projects on canal corporation lands. Currently, the Public Authorities Law disallows any waiver, even for individuals and groups involved in the Canal Clean Up Days. This amendment to the law would waive any fee for a work permit which the canal corporation has the power to issue if in its discretion the project which is subject to a work permit would add value to canal lands without any cost to the canal corporation or the state.

Paragraphs (n) and (o) of subdivision 7 of section 382 of the public authorities law, as amended by chapter 138 of the laws of 1997, are amended and a new paragraph (p) is added to read as follows: (n) enter on any lands, waters, or premises for the purpose of making borings, soundings, and surveys;[and](o) accept any gifts or any grant of funds or property from the feder- al government or from the state or any other federal or state public body or political subdivision or any other person and to comply with the terms and conditions thereof[.]; AND (P) WAIVE ANY FEE FOR A WORK PERMIT WHICH IT HAS THE POWER TO ISSUE IF IN ITS DISCRETION THE PROJECT WHICH IS SUBJECT TO A WORK PERMIT WOULD ADD VALUE TO CANAL LANDS WITHOUT ANY COST TO THE CANAL CORPORATION OR THE STATE.
