BILL NUMBER:S4957 TITLE OF BILL: An act to amend the highway law, in relation to permitting small seasonal farmers to place signs near state highways PURPOSE: To allow small agricultural businesses to place advertising signs near state highways. SUMMARY OF PROVISIONS: Section 1 amends the Highway Law by adding a new section 331, permitting farmers upon request to place, cause to be placed, or permit to be placed signs beyond 660 feet outside urban areas, with the purpose of the signage to be the indication of seasonal farms. Such signage shall be subject to the rules and regulations as provided by the commissioner. Section 2 is the effective date. JUSTIFICATION: Seasonal signs, indicating the availability of specific products to consumers, are vital to agricultural business. Farmers have generally placed signs along state highways to advertise these seasonal products, but in recent years have been notified that their actions are not permitted by law. This bill allows farmers to advertise their seasonal crops and products by placing signage along state highways beyond the current limit, so that they may continue to notify consumers of their availability and promote agri-tourism. AN ACT to amend the highway law, in relation to permitting small
seasonal farmers to place signs near state highways
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The highway law is amended by adding a new section 331 to
read as follows:
S 331. SEASONAL FARM SIGNS. SMALL SEASONAL FARMERS MAY, UPON THE
REQUEST OF THE APPROPRIATE AUTHORITY, PLACE, CAUSE TO BE PLACED, OR
PERMIT TO BE PLACED SIGNS BEYOND SIX HUNDRED SIXTY FEET OUTSIDE URBAN
AREAS AND ERECTED WITH THE PURPOSE OF THEIR MESSAGE INDICATING SEASONAL
FARMS. SUCH SIGNAGE SHALL BE SUBJECT TO THE RULES AND REGULATIONS AS
PROVIDED BY THE COMMISSIONER.
S 2. This act shall take effect immediately.
