Memo

BILL NUMBER:S4973

TITLE OF BILL: An act to amend the environmental conservation law, in relation to restricting the taking of fish, shellfish and crustacea in designated special management areas

PURPOSE: To extend the Department of Environmental Conservation's (DEC) authority to manage fish, shellfish and crustacea.

SUMMARY OF PROVISIONS: This bill would extend DEC's authority to fix, by regulation, management measures for fish, shellfish and crustacea in any designated Special Management Area until December 31, 2015.

JUSTIFICATION: Protection of the State's valuable reef ecosystems is an integral part of the overall management of the marine resources of the marine and coastal district. As defined in law, these special management areas are composed of both natural and artificial reefs, as well as shipwrecks that provide habitat and safe havens for fish, shellfish and crustacea. DEC's authority to adopt regulations restricting the taking of fish, shellfish and crustacea in these areas should be extended to assure the continuation of protective measures for reef fisheries.

LEGISLATIVE HISTORY: Last extended by Chapter 151 of the Laws of 2007.

FISCAL IMPLICATIONS: None to the State.

EFFECTIVE DATE: This act shall take effect immediately.
