BILL NUMBER:S4975 TITLE OF BILL: An act to authorize to Living Water for Women, Inc. to file an application for a real property tax exemption PURPOSE: This legislation would allow a retroactive application for real property tax exemption for Living Water for Women Inc., for property owned in the City of Glen Cove. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill would authorize the assessor of the City of Glen Cove to accept an application for an exemption from real property taxes as if made pursuant to § 420-a of the Real Property Tax Law. If satisfied that the Living Water for Women Inc. would otherwise have been entitled to said exemption, the assessor, upon approval of the city council may, in his or her sole discretion, provide for a refund or cancel all remaining unpaid taxes, interest, related fines and penalties. JUSTIFICATION: Living Water's mission is to help formerly incarcerated women so that they may become vital members of the community. Living Water for Women's goal is to establish a structured transitional home for women who have been incarcerated in the Nassau County Jail. It is intended by this bill to ameliorate the hardship that will be suffered by the Living Water for Women Inc., a charitable entity under § 420-a of the Real Property Tax Law, if it is required to pay the

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize to Living Water for Women, Inc. to file an applica- tion for a real property tax exemption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the city of Glen Cove is hereby authorized to accept from Living Water for Women, Inc. an application for exemptions from real property taxes pursuant to section 420-a of the real property tax law for the 2012-2013 assessment roll for the parcels owned by such not-for-profit corporation which are located at 83 and 95 Glen Cove Avenue, Glen Cove, New York in the county of Nassau, otherwise known as Nassau county tax map section 21, block 9, lots 352 and 353. If accepted, the application shall be reviewed as if it had been received on or before the taxable status date established for such roll. If satisfied that such not-for-profit organization would otherwise be entitled to such exemption if such not-for-profit organization had acquired the subject properties and filed an application for exemptions by the appropriate taxable status date, the assessor, upon approval by the Glen Cove city council, may make appropriate correction to the subject roll. If such exemptions are granted and such organization, therefore, shall have paid any taxes with respect to the subject roll, the applicable governing body or tax department may, in its sole discretion, provide for the refund of those taxes paid and cancel those taxes, fines, penalties, liens, or interest remaining unpaid.
