BILL NUMBER:S4994 TITLE OF BILL: An act authorizing and validating the alienation of certain parkland in the town of Kinderhook in the county of Columbia PURPOSE: To alienate the what was the old Town Park in the Town of Kinderhook. SUMMARY OF PROVISIONS: Section one authorizes and validates parkland in the Town of Kinderhook. Section two authorizes the town board of Kinderhook to discontinue and alienate the parkland. Section three states that the described parkland in the Town of Kinderhook was not purchased or funded by the State and therefore is not required to comply with requirements pertaining to alienation or conversion of parklands, including that the substitution of other lands be equivalent in fair market value and recreational usefulness. Section four is the legal description of the parkland. Section five states the effective date.

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing and validating the alienation of certain parkland in the town of Kinderhook in the county of Columbia THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provisions of law necessary to the contrary, but subject to this act, the alienation of the parkland described in section three of this act is hereby authorized and vali- dated, notwithstanding the absence of prior legislative approval. S 2. Subject to the provisions of this act, the town of Kinderhook, Columbia County, acting by and through its town board, is authorized to discontinue and alienate as parkland the lands described in section four of this act for such purposes as are consistent with the town's compre- hensive plan, which may be modified in accordance with the requirements of such plan. S 3. The town of Kinderhook, Columbia County is not required to comply with any federal requirements pertaining to the alienation or conversion of parklands, including satisfying the secretary of the interior with all conditions which the secretary of the interior deems necessary to assure that the substitution of other lands be equivalent in fair market value and recreational usefulness to the lands being alienated or converted, as the lands described in section four of this act were not purchased with or funded by state monies. S 4. The lands to be discontinued as parkland and alienated and conveyed pursuant to section two of this act are bounded and described as follows: ALL that piece or parcel of land generally known as the former Niver- ville Schoolhouse premises of the Kinderhook Central School District located in the Hamlet of Niverville, Town of Kinderhook, Columbia Coun- ty, New York. The town of Kinderhook, in the county of Columbia, is here- by authorized to discontinue use of certain parklands more particularly described in section three of this act and sell and convey in fee simple for its fair market value and upon such terms and conditions, as deter- mined by the town board. S 2. The authorization provided for in section one of this act shall only be effective on the condition that the town of Kinderhook shall dedicate the fair market value of such lands for the acquisition of additional parkland and/or capital improvements to existing park facili- ties in the town of Kinderhook. S 3. The lands to be discontinued as parkland and alienated and conveyed pursuant to section two of this act are bounded and described as follows: ALL that piece or parcel of land generally known as the former Niver- ville Schoolhouse premises of the Kinderhook Central School District located in the Hamlet of Niverville, Town of Kinderhook, Columbia Coun- ty, New York. BEGINNING at a point referenced as south 45 degrees, 30 minutes west and distant 105.7 feet from the steel fence post designated the south- westerly corner of the present school premises as conveyed by John Raeder and wife by deed dated April 10, 1880 and recorded in the office of the clerk of Columbia County, New York in Liber 72 at page 472; thence north 88 degrees 45 minutes east 159.14 feet to the northwesterly EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
