BILL NUMBER:S5011 TITLE OF BILL: An act to amend chapter 879 of the laws of 1939, relating to a separate union free school district in the town of Mount Pleasant in the County of Westchester, in relation to clarifying the authority of the school district to utilize certain property located outside of its boundaries PURPOSE OF BILL: This legislation is necessary to authorize the Hawthorne Cedar Knolls Union Free School district to continue to provide educational programming for the Geller House located at 77 Chicago Avenue, Staten Island, New York 10305. SUMMARY OF PROVISIONS: Chapter 879 of the laws of 1939 is amended by adding a new section 2-a, to authorize the continuance of educational programming to the Geller House located in Staten Island, New York. JUSTIFICATION: The Gellar House is a short term residential diagnostic rapid intervention center operated by the Jewish Board of Family and Children's Services in cooperation with the Hawthorne Cedar Knolls

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 879 of the laws of 1939, relating to a separate union free school district in the town of Mount Pleasant in the County of Westchester, in relation to clarifying the authority of the school district to utilize certain property located outside of its boundaries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 879 of the laws of 1939, relating to a separate Union Free School District in the town of Mount Pleasant in the County of Westchester is amended by adding a new section 2-a to read as follows: S 2-A. NOTWITHSTANDING ANY OTHER LAW, RULE, OR REGULATION TO THE CONTRARY, IN ADDITION TO THE POWERS GRANTED BY SECTION ONE OF THIS ACT, SUBJECT TO THE APPROVAL OF THE NEW YORK STATE EDUCATION DEPARTMENT, THE BOARD OF EDUCATION SHALL BE AUTHORIZED TO LEASE PROPERTY LOCATED AT 77 CHICAGO AVENUE, IN THE BOROUGH OF STATEN ISLAND, CITY OF NEW YORK, FOR THE PURPOSE OF PROVIDING INSTRUCTION TO STUDENTS ENROLLED IN THIS SCHOOL DISTRICT. S 2. The actions of the board of education of the Hawthorne Cedar Knolls Union Free School District in entering a lease of properties located at 77 Chicago Avenue, in the borough of Staten Island, city of New York, prior to the effective date of this act, are hereby ratified, validated and confirmed notwithstanding its location outside of the school district boundaries. S 3. Nothing in this chapter shall authorize Hawthorne Cedar Knolls Union Free School District and Jewish Board of Family and Children's Services, Inc., (JBFCS), formerly known as Jewish Board of Guardians, from effectuating the transactions authorized under this act without first obtaining any government approvals, consents, licenses, permits and accreditation otherwise required under law. S 4. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
