TITLE OF BILL: An act to amend chapter 879 of the laws of 1939, relating to a separate union free school district in the town of Mount Pleasant in the County of Westchester, in relation to clarifying the authority of the school district to utilize certain property located outside of its boundaries

PURPOSE OF BILL:

This legislation is necessary to authorize the Hawthorne Cedar Knolls Union Free School District to continue to provide educational programming for the Geller House located at 77 Chicago Avenue, Staten Island, New York 10305.

SUMMARY OF PROVISIONS:

Chapter 879 of the laws of 1939 is amended by adding a new section 2-a, to authorize the continuance of educational programming to the Geller House located in Staten Island, New York.

JUSTIFICATION:

The Gellar House is a short term residential diagnostic rapid intervention center operated by the Jewish Board of Family and Children's Services in cooperation with the Hawthorne Cedar Knolls Union Free School District which provides the facility's educational services. The association is required because the Hawthorne Cedar Knolls Union Free School District provides year round access to education to the residents at the Gellar House who are unable to attend school during the regular public school year when schools are closed during the summer, holidays, spring break and other times of recess.

The New York State Department of Education recently identified a technical inconsistency with this education collaboration and indicated legislation is necessary to resolve this discrepancy and allow the Hawthorne Cedar Knolls Union Free School District to continue educational programming at the Gellar House.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend chapter 879 of the laws of 1939, relating to a separate union free school district in the town of Mount Pleasant in the County of Westchester, in relation to clarifying the authority of the school district to utilize certain property located outside of its boundaries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 879 of the laws of 1939, relating to a separate Union Free School District in the town of Mount Pleasant in the County of Westchester is amended by adding a new section 2-a to read as follows: S 2-A. NOTWITHSTANDING ANY OTHER LAW, RULE, OR REGULATION TO THE CONTRARY, IN ADDITION TO THE POWERS GRANTED BY SECTION ONE OF THIS ACT, SUBJECT TO THE APPROVAL OF THE NEW YORK STATE EDUCATION DEPARTMENT, THE BOARD OF EDUCATION SHALL BE AUTHORIZED TO UTILIZE PROPERTY LOCATED AT 77 CHICAGO AVENUE, IN THE BOROUGH OF STATEN ISLAND, CITY OF NEW YORK, FOR THE PURPOSE OF PROVIDING INSTRUCTION TO STUDENTS ENROLLED IN THIS SCHOOL DISTRICT. S 2. The actions of the board of education of the Hawthorne Cedar Knolls Union Free School District in entering a lease of properties located at 77 Chicago Avenue, in the borough of Staten Island, city of New York, prior to the effective date of this act, are hereby ratified, validated and confirmed notwithstanding its location outside of the school district boundaries. S 3. Nothing in this chapter shall authorize Hawthorne Cedar Knolls Union Free School District and Jewish Board of Family and Children's Services, Inc., (JBFCS), formerly known as Jewish Board of Guardians, from effectuating the transactions authorized under this act without first obtaining any government approvals, consents, licenses, permits and accreditation otherwise required under law. S 4. This act shall take effect immediately.
